我国网络直销法律规制研究

【摘要】:近些年来,网络直销作为一种新的营销模式正在为我国越来越多的企业所采用。网络直销的迅速发展,给广大消费者带来了巨大便利,极大地促进了电子商务向更深层次地发展。与许多新兴产业一样,网络直销在给人们带来极大便捷的同时,在实践中出现了许多问题也产生了一些不良后果。这些问题的出现暴露出我国现行法律法规在规制网络直销方面存在的滞后性缺陷。完善相应法律法规,规范网络直销行为,对于保护网络直销消费者合法权益,促进我国网络直销业健康有序的发展具有重要的理论与现实意义。本文分为四个部分: 第一部分对网络直销的含义和法律特征进行了分析,重点分析了了网络直销与非法传销之间的区别;第二部分分析了我国网络直销的现状,指出了我国网络直销存在的主要问题;第三部分介绍了国外主要国家和国际组织的网络直销制度,总结了它们在网络直销方面的成熟经验;第四部分在梳理我国网络直销规制相关法律法规的基础之上,结合我国网络直销实际情况,提出了一些完善我国网络直销法律规制制度的对策和建议。
[Abstract]:In recent years, as a new marketing model, network direct selling is being adopted by more and more enterprises in our country. The rapid development of network direct selling has brought great convenience to consumers and greatly promoted the development of electronic commerce to a deeper level. Like many new industries, network direct selling has brought great convenience to people, and at the same time, there are many problems in practice and some adverse consequences. The emergence of these problems reveals the lagging defects of the current laws and regulations of our country in regulating network direct sales. It is of great theoretical and practical significance to perfect the relevant laws and regulations and standardize the direct selling behavior of the network to protect the legitimate rights and interests of the consumers of the network direct selling and to promote the healthy and orderly development of the network direct selling industry in our country. This paper is divided into four parts: the first part analyzes the meaning and legal characteristics of network direct selling, focusing on the analysis of the difference between network direct selling and illegal pyramid selling; The second part analyzes the current situation of China's network direct marketing, and points out the main problems of our country's network direct marketing. The third part introduces the network direct selling system of foreign countries and international organizations, and summarizes their mature experience in network direct selling. The fourth part on the basis of combing the related laws and regulations of China's network direct sales regulation, combined with the actual situation of China's network direct selling, put forward some countermeasures and suggestions to improve our network direct marketing legal regulation system.
