论我国内外资企业法制的协调

【摘要】：在改革开放初期计划经济的特殊历史背景下,我国对外商投资企业法律进行立法,但随着市场经济的发展,内外资企业法律制度的冲突不断暴露出来.外资企业法律体系内部的不协调,其与内资企业法的冲突以及其对国际条约基本原则的背离等原因促使笔者对这些冲突的解决路径作出思考.对此,笔者提出统一内外资企业法律形态、重组法律体系、提高立法水平、借鉴国外经验等建议.
[Abstract]:Under the special historical background of planned economy in the early stage of reform and opening up, our country legislates the law of foreign-invested enterprises, but with the development of market economy, the conflict of legal system of domestic and foreign enterprises is constantly exposed. The disharmony within the legal system of foreign-funded enterprises, its conflict with domestic enterprise law and its deviation from the basic principles of international treaties urge the author to think about the ways to resolve these conflicts. In view of this, the author puts forward some suggestions, such as unifying the legal form of domestic and foreign enterprises, reorganizing the legal system, improving the legislative level, and drawing lessons from foreign experience.
