当前我国快递行业监管存在的问题与对策研究

【摘要】：近十年来,随着互联网技术的日新月异和电子商务的蓬勃发展,网购与快递已成为人们日常生活中极为常见的交易活动,其方便、及时、快捷深受广大消费者的青睐,但由于行业发展迅猛而行业监管跟不上,我国快递行业凸显了诸多问题。制度层面,我国邮政体制改革后,国家邮政局成为快递行业行政主管部门,但相关法律法规不健全、规定不甚合理。现实层面,我国本土大中小型民营快递企业迅速壮大和扩张,存在着加盟门槛极低、经营灵活但管理较混乱等问题。许多快递公司存在收寄验视制度执行不到位、安全管理措施难到位、快件损毁丢失、管理人才欠缺等问题。当前我国快递行业监管以邮政管理部门监管为主,辅之以公安部门治安管理、工商等部门职责内监管。主要法律规制为《中华人民共和国邮政法》《快递市场管理办法》《邮政行业安全监督管理办法》等,主要监管手段为许可准入、安全检查等。本文从我国快递行业监管现状出发,分析当前快递行业监管存在的问题,将其归纳为行业监管法律法规混乱、市场准入许可设置不合理、行业监管手段单一监管效能低下、行业安全生产隐患和治安隐患突出、行业自治组织薄弱无力等问题,由此出发,我们提出了提高立法的透明度和公众参与度、降低快递行业市场准入门槛并促进市场竞争、丰富监管手段创新监管方式提高监管效能、公安部门加强快递行业治安管控、充分发挥快递协会行业自律作用等5个方面的对策建议,旨在完善快递行业监管,促进行业发展。
[Abstract]:In the past ten years, with the rapid development of Internet technology and e-commerce, online shopping and express delivery has become a very common trading activities in people's daily life. However, due to the rapid development of the industry and industry regulation can not keep up, China's express delivery industry highlights many problems. At the system level, after the reform of the postal system, the State Post Office has become the administrative department in charge of express delivery industry, but the relevant laws and regulations are not perfect and the regulations are not very reasonable. In reality, the local large, medium and small private express delivery enterprises grow rapidly and expand rapidly, there are such problems as low threshold to join, flexible management but confused management and so on. Many express delivery companies do not carry out inspection system, safety management measures are difficult to put in place, courier damage and loss, lack of management personnel and so on. At present, the supervision of express delivery industry in our country is based on the supervision of postal administration department, supplemented by public security department, industry and commerce department. The main legal regulations are the Post Law of the people's Republic of China, the Management measures of Express Market, the measures of Supervision and Administration of Postal Safety, and the main means of supervision, such as permission access, safety inspection and so on. Starting from the current situation of express delivery industry supervision in China, this paper analyzes the problems existing in the current express industry supervision, and concludes it as the confusion of industry supervision laws and regulations, the unreasonable setting of market access permission, the low efficiency of single supervision means of industry supervision. The hidden dangers of production safety and public security in the industry are prominent, and the autonomous organizations of the industry are weak and weak. From this, we propose to improve the transparency of legislation and public participation, lower the barriers to market access in the express delivery industry and promote market competition. In order to perfect the supervision of express industry and promote the development of express industry, it is necessary for the public security department to strengthen the security control of express delivery industry and to give full play to the self-discipline role of express delivery association in order to improve the supervision of express industry and promote the development of express industry.
