互联网保险对于传统保险法律规则的冲击与重塑——以类型化分析为视角

【摘要】：互联网保险已经成为拉动保费增长的重要因素之一,其不仅具有传统保险的性质与特点,同时又带来了互联网本身所存在的风险与隐患。以类型化分析为切入点,根据保险利益与互联网依附程度的不同,可以将互联网保险分为互联网信息安全保险、O2O保险、网销保险三种类型。文章以三种类型保险涌现出的法律问题为主要研究角度,对互联网保险对于传统保险法律规则的冲击进行探讨并提出修改与完善的建议,以期对互联网保险的发展贡献一定的力量。
[Abstract]:Internet insurance has become one of the most important factors driving premium growth. It not only has the nature and characteristics of traditional insurance, but also brings risks and hidden dangers to the Internet itself. According to the different degree of insurance interest and Internet dependence, Internet insurance can be divided into three types: Internet information security insurance, O2O insurance and net selling insurance. This paper discusses the impact of Internet insurance on the legal rules of traditional insurance and puts forward some suggestions for modification and perfection, taking the legal problems arising from three types of insurance as the main research angle. With a view to the development of Internet insurance contribution to a certain strength.
