论我国破产法的适用范围

【摘要】：在我国市场经济深入建设和发展的时期,现行破产法仅限于企业法人的适用范围,已然不能满足社会发展的需求,对债权债务关系解决显得力不从心。现阶段,我国经济活动日渐频繁,经济主体不断增长,债务清偿问题逐渐显化,严重影响了我国市场经济体制的正常运转。本文在对我国破产法适用范围发展现状作出简要论述的基础上,分析了决定我国破产法适用范围的要素,并就我国破产法适用范围的扩大进行了研究。
[Abstract]:In the period of deep construction and development of China's market economy, the current bankruptcy law is limited to the scope of application of the enterprise legal person, and can not meet the needs of social development, so the solution to the relationship between creditor's rights and debts appears to be unable to meet the needs of social development. At present, our country's economic activities are becoming more and more frequent, the economic main body is increasing constantly, and the problem of debt settlement is gradually manifested, which seriously affects the normal operation of the market economy system of our country. On the basis of a brief discussion on the development of the scope of bankruptcy law in China, this paper analyzes the elements that determine the scope of application of the bankruptcy law of our country, and studies the expansion of the scope of application of our country's bankruptcy law.
