广东金融消费权益保护联合(协)会发展及对策研究

【摘要】:2008年金融危机爆发后,金融消费者保护成为世界性重要命题,偏重金融体系的稳健经营和行业效率,将消费者保护居于从属地位的传统监管模式受到质疑。以经济学家泰勒提出的“双峰”理论为基础,主要发达国家从金融消费者保护专项立法、监管机构重塑、强化信息披露、设立金融纠纷解决机构、完善保障和补偿机制、开展国民金融教育等入手,构建了完备的金融消费权益保护体系。随着我国金融现代化进程的加快,金融业务产品的不断创新,金融领域矛盾纠纷的复杂化,国内金融消费权益保护日益受到重视和关注。当前国内的理论研究居多,实践研究偏少,对基层生存状况的研究则更少,从金融消费者保护的主体分析,监管“倚赖”仍占上风,对社会组织的研究还局限于传统的金融行业协会。法规制度滞后,监管手段单一,保护金融消费者仅靠行政的力量难以深入,尤其在“一行三会”的分业监管体制下,跨行业跨市场的交叉性保护问题凸显,而越到基层,保护的力量越薄弱。广东19个地市金融消费权益保护联合(协)会的成立,在金融机构、消费者本身、金融监管部门、金融行业协会之外,创造了第三方公益组织这一新型的消费者保护主体。它统合大金融领域,打破行业边界,摆脱行业协会不够中立的尴尬,跨越法规制度屏障,整合利用社会资源,立足地方实际、民众需求全面履行金融消费权益保护具体职能,有力推动基层金融消费权益保护的进程,为完善我国金融消费权益保护体系开辟了新途。党的十八大、十八届三中全会明确提出要发展社会组织,进一步转变政府职能。本文通过对广东各地市金融消费权益保护联合(协)会的性质宗旨、组织架构、主要职能、运行机制、发展现状,履职成效的描述,分析其发展中的问题、困难,思考相应的对策建议,得出结论:基于金融领域的“公共属性”,公益社团组织模式开展金融消费权益保护符合社会治理的时代精神,顺应大金融融合发展的趋势,能为监管决策提供依据和参考,有助于维护基层和谐与稳定。
[Abstract]:After the financial crisis broke out in 2008, financial consumer protection has become an important proposition in the world. On the basis of the "double peak" theory put forward by economist Taylor, the major developed countries, from the special legislation on financial consumer protection, the remolding of the regulatory bodies, the strengthening of information disclosure, the establishment of financial dispute resolution institutions, and the improvement of the mechanism of protection and compensation, Starting with the development of national financial education, a complete system of protecting financial consumption rights and interests has been established. With the acceleration of the process of financial modernization, the continuous innovation of financial business products and the complication of contradictions and disputes in the financial field, the protection of domestic financial consumption rights and interests has been paid more and more attention to. At present, there are more theoretical studies, less practical studies and less research on the basic living conditions in China. From the analysis of the main body of financial consumer protection, supervision "dependence" still prevails. The study of social organizations is also limited to traditional financial industry associations. The legal system lags behind, the means of supervision are single, and it is difficult to go deep into the protection of financial consumers only by administrative power. Especially under the separate supervision system of "one line and three sessions", the cross-industry and cross-market protection problems are highlighted, and the problem of cross-market protection becomes more and more serious at the grass-roots level. The weaker the force of protection. In addition to financial institutions, consumers themselves, financial regulatory authorities and financial industry associations, the establishment of 19 joint associations of financial consumption rights and interests in Guangdong has created a new type of consumer protection body, a third-party public welfare organization. It integrates the big financial field, breaks the industry boundary, gets rid of the embarrassment that the trade association is not neutral enough, surmounts the legal system barrier, integrates and uses the social resources, bases on the local reality, and the people's demand comprehensively performs the specific function of protecting the financial consumption rights and interests. The process of promoting the protection of financial consumption rights and interests at the grassroots level has opened a new way for perfecting the system of protecting financial consumption rights and interests in China. The 18th CPC National Congress and the third Plenary session of the 18th CPC Central Committee explicitly proposed to develop social organizations and further transform government functions. Based on the description of the nature and purpose, organizational structure, main functions, operating mechanism, development status and achievements of the Association for the Protection of Financial consumption Rights and interests in Guangdong, this paper analyzes the problems and difficulties in its development. Considering the corresponding countermeasures and suggestions, we can draw a conclusion: based on the "public attribute" of the financial field, the organization mode of the public welfare association to develop the financial consumption rights and interests protection conforms to the spirit of the times of social governance and conforms to the trend of the development of the great financial integration. It can provide basis and reference for supervision and decision, and help maintain harmony and stability at grassroots level.
