股权众筹平台监管缺失的民间替代及其社会分析

【摘要】：股权众筹作为互联网金融的典型表现之一,其监管制度的缺失,在社会分析看来可表现为社会制度顶层设计的缺乏与社会自发的制度较为多见两方面。文章认为,其产生的原因在于法治化监管的保守社会意识与股权众筹的社会运行具有矛盾,而互联网金融监管的未来发展方向仍应走法治化路径,其路径设计应尊重社会自发制度的经验。
[Abstract]:As one of the typical manifestations of Internet finance, the lack of supervision system of equity crowdfunding can be seen in two aspects: the lack of top-level design of social system and the spontaneous system of society. The paper holds that the reason lies in the contradiction between the conservative social consciousness of legalized supervision and the social operation of equity crowdfunding, and the future development direction of Internet financial supervision should still take the path of legalization. Its path design should respect the experience of social spontaneous system.
