论滥用市场支配地位的反垄断法规制

【摘要】：滥用市场支配控制制度是反垄断法的重要组成部分，在竞争日益激烈的当今社会，我们不能忽视它的重要作用。滥用市场支配地位控制制度的设定旨在维护市场的自由竞争以及消费者的权益，从而为市场经济的良好运营提供一个健康的环境。在我国，有关滥用市场支配地位的反垄断法规制研究脚步缓慢，虽然有一部分学者积极投身于反垄断法的完善工作里，提出了一些合理的建议，但是，，总体来说，现存的研究成果远远满足不了反垄断执法实践的需求。这就要求我们加快相关制度研究的速度，进一步探索和完善禁止滥用市场支配地位制度。本文用五个部分内容阐述了滥用市场支配地位控制制度的研究内容本文第一章开篇是引言部分，对选题的意义和目的进行了阐述，为论文正题的进行做了一个铺垫。之后详细表述了国内外的研究现状，从而为论文的研究和论题的完善指明了研究方向。本文第二章首先阐述了滥用市场支配地位的涵义和认定原则，并在此基础理论上对滥用市场支配地位进行了典型行为列举，从而对本文的研究范围有了初步了解;随后，本文从价值角度对滥用市场支配地位给市场竞争、经济发展和消费者权益保护带来的危害进行了分析，从而让我们意识到此研究的重要性和迫切性。在第三章详细阐述了一些西方发达国家和相关组织在滥用市场支配地位的反垄断规制方面的立法现状，也指出了一些与我国反垄断法不同的地方。通过借鉴，在本章最后介绍了外国立法对我国的一些启示。第四章讲解了我国禁止滥用市场支配地位的现行立法及配套法律规定。之后，找出了《反垄断法》在规制滥用市场支配地位方面存在的不足和缺陷，从而使我国反垄断法的完善更具针对性。最后一章立足于我国实际国情，提出了一些如何完善反垄断法中关于滥用市场支配地位的相关建议，以期对中国的反垄断法研究和司法实践产生积极影响。
[Abstract]:The abuse of the dominant control system of the market is an important part of the anti-monopoly law, and in the increasingly competitive society, we can't ignore the important role of the anti-monopoly law. The setting of the control system of the abuse of the dominant position of the market is to maintain the free competition of the market and the rights and interests of the consumers, thus providing a healthy environment for the good operation of the market economy. In our country, the study of the anti-monopoly law regulating the dominant position of the market is slow, although some scholars have actively engaged in the improvement of the anti-monopoly law, some reasonable suggestions are put forward, but in general, The existing research results are far from the demand of the anti-monopoly law enforcement practice. This requires us to speed up the research of related systems, to further explore and improve the system of the prohibition of the abuse of market dominance. In this paper, the research contents of the control system of abuse of the dominant position of the market are described in five parts. In the first chapter, the first chapter is the introduction, and the meaning and purpose of the topic is set forth. The research situation of domestic and foreign research is described in detail, so that the research and research of the thesis are pointed out. In the second chapter, the meaning and the principle of the abuse of the dominant position of the market are described in the second chapter, and the typical behavior of the abuse of the dominant position of the market is listed on the basis of this basic theory. Then, this paper analyzes the harm of the abuse of the dominant position of the market to the market competition, the economic development and the protection of the consumer's rights from the value point of view, so as to make us realize the importance of this research. In the third chapter, the legislation status of some western developed countries and relevant organizations in the anti-monopoly regulation of the abuse of market dominance is described in detail, and some anti-monopoly law with China is also pointed out. In this chapter, we introduce foreign legislation to our country. The fourth chapter explains the current legislation prohibiting the abuse of the dominant position of the market in our country After that, the defects and defects of the anti-monopoly law in the regulation of the dominant position of the abuse market are found out, so that the anti-monopoly law in China is made The last chapter, based on the actual situation of our country, puts forward some suggestions on how to perfect the dominant position of the market in the anti-monopoly law, with a view to the research and division of the anti-monopoly law in China
