英语立法文本中Shall作为道义情态动词的历时研究

Shall（not）在法律英语中广泛使用,表达授权、强制和禁止等法律言语行为。“某个立法条文甚至整部立法文本翻译质量的优劣在很大程度上取决于shall译文的准确程度”（谢晓莺,马艳姿,2010）。然而对shall的使用问题上却存在一种矛盾的现象。在英文文献中:一方面将大量使用shall列为法律英语的特征,另一方面有学者批评shall在法律英语中的滥用。中文文献中的情况相似:一方面有学者批评shall在中文法律英译中的滥用,另一方面现行中文法律英译本（国家和地方）中shall滥用的情况仍然存在。那shall是否仍然为法律英语中的最主要词汇?造成shall使用的这些矛盾现状的原因是什么?论文作者首先揭示在立法文本中shall使用问题上的矛盾现象。她接着对言语行为理论、情态动词的分类和英语简明化运动做文献综述。在此基础上作者主要以1789-2014年间的3部英语为母语的法律法规为语料,使用Microsoft等软件和人工统计的方法,统计分析立法言语行为中道义情态shall运用的变化与使用现状。数据收集与统计结果揭示:当今英美国家现行法律正逐步淡化shall的使用,而用may、must等其他情态...
