立法语篇中主位推进模式的逻辑性及翻译方法

　　作为逻辑思维的重要体现，主位推进模式不仅决定了立法语篇的构成，而且决定了语篇信息结构的分布。本篇论文以1979年7月1日第五届全国人民代表大会第二次会议通过,1997年3月14日第八届全国人民代表大会第五次会议修订的《中华人民共和国刑法》作为语料样本，将452条，752款按照性质型命题，定义型命题，规范型命题，准用型命题，陈述型命题分为五大类，分别研究分析每一类型命题的语篇构成，主位推进模式，及其信息结构的分布。虽然大陆法系与英美法系存在异质性，但是在立法语篇层面都严格遵循着语篇的逻辑性规则，立法语篇中的逻辑性主要体现在立法文本的构成上，无论是宏观层面还是微观层面逻辑无处不在，为了使语篇连贯通顺，不仅大量使用逻辑联结词，而且在语篇信息结构的分布上也严格遵循着逻辑思维。由于英汉两种语言在语言组织结构和表达法上的根本差异，导致了在立法语篇文本构成上体现着不同的逻辑思维。这对译文的准确性及忠实度提出了更高的要求，不仅要准确译出原文的意义和立法意图，更重要的是达到与原语等同的法律效果。在立法文本的英译过程中，如何在准确传达原文意义和立法意图的基础上实现逻辑思维的成功转换成为评价译文质量的重要标...
