汉英立法文本的句法特征及其文化阐释

近年来有关法律语言的特征分析、法律语言风格特征、法律语言与翻译原则等研究方面出现了一些论文或论著,但关于英汉法律语言的句法对比研究方面尚有很大研究的空间。为此,本文试图通过分析英汉立法语言的语体和句法特征,从传统文化的角度论述了产生这些句法差异的原因,以期对法律语言的深入研究奠定一定基础。论文除引言和结语外,共由四章组成。第一章简要分析了立法语言的主要特征。作者结合法律的特征,即规范性、权威性和抽象性,分析了相应的立法语言特征,即精确性、晦涩性和机械性。第二章主要介绍汉英立法文本的句法特征。文章从句法的定义及其研究对象出发,探讨了汉英立法文本在综合语与分析语、形合与意合、语序、句子信息结构安排、主语突显与话题突显及主动语态与被动语态等六个方面的句法差异。汉语以分析语为主要特征,主要靠意合手段组合句子;它以意念为主轴,话题突显,多用人称主语和主动语态。此外,汉语的词序安排主要以时、空发展及心理上的轻重为序,重隐性连贯;句子信息中心一般后置,呈句首开放、句尾封闭型分布。而英语则属于分析-综合语,主要靠形合手段组合句子。它以主谓提挈为主轴,主语突显,常用物称主语和被动语态。词序安排上重逻辑推...
