英汉立法条件句对比及其翻译研究

随着国际交流活动日趋频繁,法律翻译逐渐成为跨地区和跨文化研究的重点。立法文本,作为一种特殊的法律文本,其词汇、句法和篇章早已成为学者们所关注的重要问题。不难发现,在中英文立法文本中,条件句均有着非常高的使用频率。较之于其他文本中的条件句,立法文本中的条件句式往往冗长且复杂。此外,由于中英文两种截然不同的语法规则,条件句在立法文本中也有着截然不同的表现方法。鉴于此,笔者收集整理了大约50万字(词)的现行中英文立法文本,建立了中英文本的平行语料库,并提取了4,498个中英文条件句和7个常用的英文条件句从属连词。通过对中英文语料进行对比分析,本文作者发现:在本语料库的所有中英文句子中,共有4,498个条件句,占全部句子的40%;在提取的所有英文条件句中,由“if”引导的条件句占56%;所有的英文条件句都由显性从属连词所引导,然而在其对应的中文条件句中,仅有25%的条件句是由显性的中文从属连词所引导的,余下75%均由隐性词语所引导;为了强调“条件”,中英文从句都倾向于“左移结构”。根据上诉总结概括的英汉立法文本中条件句的异同,在英汉法律条件句的互译过程中,译者需要区分两种法律条件句的固有表达方...
