非政府组织参与刑事强制医疗程序研究

【摘要】：作为2012年《刑事诉讼法》修改新增的特别程序,刑事强制医疗程序面临着社会资源供给严重不足的因境。而非政府组织以其承担协助、援助、代表和监督等职能可以将社会资源引入刑事强制医疗程序。非政府组织参与强制医疗程序有利于实现我国刑事诉讼程序的精细化和专业化,有利于贯彻尊重和保障人权的精神。为确保非政府组织的参与行为在法制框架内规范运行,必须从启动、参与、救济和监督机制等方面构建我国非政府组织参与强制医疗程序机制。
[Abstract]:In 2012, the Criminal procedure Law was amended as a new special procedure, the criminal compulsory medical procedure is faced with the serious shortage of social resources. The functions of representative and supervision can introduce social resources into criminal compulsory medical procedures. The participation of non-governmental organizations in compulsory medical procedures is conducive to the refinement and specialization of criminal procedure in China. It is conducive to the implementation of the spirit of respect for and protection of human rights. In order to ensure that the participation of non-governmental organizations is regulated within the framework of the rule of law, it is necessary to start and participate. In the aspect of relief and supervision mechanism, non-governmental organizations in our country participate in compulsory medical procedure mechanism.
