诱惑侦查规制路径研究——以我国最新修改的《刑事诉讼法》第151条第一款为研究基点

【摘要】：最新修改的《刑事诉讼法》第151条第一款是诱惑侦查措施的研究基点。为实现侦查机关可以合法高效地实施诱惑侦查措施,应在厘清诱惑侦查概念及其合法性的基础上,深入分析我国诱惑侦查实施现状,探索出适合我国国情的诱惑侦查规制路径:应当在部门法规中增加对诱惑侦查措施的规制细则;应当排除利用"警察圈套"收集的证据,形成对侦查机关实施诱惑侦查行为的动态规制;应当不断规范侦查机关实施诱惑侦查的策略方法,增加实施过程的录音录像,形成对诱惑侦查过程的实时规制。
[Abstract]:The latest revision of the "Criminal Procedure Law" the 151st the first is on the basis of the temptation investigation measures. In order to realize the efficient implementation of the investigation organ legal temptation investigation measures should be based on clarifying the concept of temptation investigation and its legitimacy, in-depth analysis of the implementation of the investigation is to explore China's temptation, temptation investigation regulation path for the situation of our country, should be increased to the temptation investigation measures of regulation rules in the department regulations; shall preclude the use of "police trap" to collect evidence, the formation of dynamic regulation of entrapmental investigation of investigation organ shall continue to regulate the strategy; the implementation of the investigation organ temptation investigation, increase the implementation process of recording, real-time regulation the temptation of the investigation process.
