论司法责任制下的检察官惩戒

【摘要】：2015年最高人民检察院颁发的《关于完善人民检察院司法责任制改革的若干意见》明确了司法责任制改革的目标、检察官、辅助检察官、检察长的权力清单,但对检察官惩戒程序规定的较少。应以与司法责任制改革协调的视角进一步完善检察官惩戒程序:在惩戒事由上以违反职业道德规范的不当行为为主要对象;在惩戒措施上,应排除开除、免职等涉及检察官身份的惩戒措施,并充实能够保障检察院独立的相对轻缓的惩戒措施;在惩戒程序上,不仅应强化惩戒委员会的中立性,而且应强化对被诉检察官的程序保障。
[Abstract]:In 2015, the Supreme people's Procuratorate issued "some opinions on perfecting the Judicial responsibility system Reform of the people's Procuratorate", which defined the objectives of the judicial responsibility system reform, the list of powers of the procurators, auxiliary prosecutors, and procurators. However, there are few provisions on the disciplinary procedures of prosecutors... The disciplinary procedures of prosecutors should be further improved from the perspective of coordination with the reform of judicial responsibility system: the main object of disciplinary matters is misconduct in violation of professional ethics, and in disciplinary measures, Disciplinary measures involving the status of prosecutors, such as dismissal and removal, should be excluded, and the relatively mild disciplinary measures that would guarantee the independence of the procuratorate should be enriched. In disciplinary proceedings, not only should the neutrality of the disciplinary committee be strengthened, Moreover, the procedural protection of the accused prosecutor should be strengthened.
