律师参与涉法涉诉信访工作机制研究

【摘要】：在当下涉法涉诉信访案件激剧增多,社会矛盾化解对于社会和谐稳定越来越重要的前提下,探索和研究律师参与涉法涉诉信访工作,发挥律师从中立客观的角度化解涉法涉诉信访矛盾具有重要的意义。充分利用律师懂法知法、客观中立、熟悉社情民意的优势,深入挖掘律师这一法律职业团体在参与涉法涉诉信访工作中的价值。在开展律师参与信访矛盾化解和代理申诉案件工作中,要严格依法推进、做好协调保障、确立科学合理的工作模式,着力推动涉法涉诉信访法治化进程,破解涉法涉诉信访疑难问题,保证人民群众依法行使权利和保护自身权益。本文以呼和浩特市人民检察院开展律师参与涉法涉诉信访工作的实践情况为例,通过对典型案例分析,总结现阶段工作开展的现状和存在的问题,探究完善律师参与涉法涉诉信访工作机制的对策和建议。
[Abstract]:On the premise of increasing the number of litigant petition cases and resolving social contradictions for social harmony and stability, this paper explores and studies the participation of lawyers in the petition and petition work. It is of great significance for lawyers to resolve the contradiction between litigation and petition from a neutral and objective perspective. Fully utilize the advantages of knowing the law, being objective and neutral, and familiar with the social situation and public opinion, and making full use of lawyers' understanding of the law and law. Deeply excavating the value of lawyer, a legal professional organization, in participating in the work of litigation, complaint and petition. In carrying out the work of lawyers' participation in resolving contradictions in letters and visits and in representing complaints, we should strictly promote it in accordance with the law, and do a good job of coordination and protection. To establish a scientific and reasonable mode of work, to push forward the process of legalization of petition and visit involving law, and to solve the difficult problems of petition and visit involving law, To ensure that the masses exercise their rights and protect their own rights and interests according to the law. This paper takes the practice of the people's Procuratorate of Hohhot City to engage in the practice of lawyers' participation in the work of petition and petition involving legal claims as an example, through the analysis of typical cases. This paper summarizes the present situation and existing problems of the present work, and probes into the countermeasures and suggestions for perfecting the mechanism of lawyers' participation in the work of litigation and petition.
