司法改革视域下我国法官独立审判问题研究

【摘要】：要实现司法公正,就必须在司法独立的大环境下才可以实现,否则法官独立审判无从谈起。法官独立审判的实现,才是司法独立的价值导向。法官是否具有独立的审判权,是司法独立能否实现的关键,同时也关系着社会民众公平正义的实现。在中国,虽然在宪法中已经明确规定了法院具有独立审判的权利,但法官独立审判在我国的法律条文中却没有涉及,而法院独立审判与法官独立审判混为一谈就显得大错特错。而在我国司法实践中,不管是在政治层面、还是司法制度的设计上,法官的独立审判都难以得到有效落实。审判不独立,将会引发我国司法出现地方化的趋势,司法不公也将难以杜绝,进而损害司法权威,并阻碍司法公正和效率的提高。本文将法官独立审判原理和西方国家法官独立审判制度的发展历程相结合,借鉴其制度的先进性并结合我国国情构建我国法官独立审判制度。在分析了影响我国法官独立审判因素的原因后,找到我国司法制度中出现的司法缺陷,并从法官专业化管理、职业保障、责任制、法官文化以及立法建议等方面提出了一些见解。
[Abstract]:In order to realize judicial justice, it must be realized under the environment of judicial independence, otherwise the judge can not judge independently.The realization of independent judge trial is the value orientation of judicial independence.Whether the judge has independent jurisdiction is the key to the realization of judicial independence, and it is also related to the realization of fairness and justice.In China, although the constitution has clearly stipulated that the court has the right of independent trial, the independent trial of judges is not covered in the legal provisions of our country, and it is wrong to confuse the independent trial of the court with the independent trial of the judge.In the judicial practice of our country, whether in the political level or in the design of the judicial system, the independent trial of judges is difficult to be effectively implemented.If the trial is not independent, it will lead to the localization of the judicature in our country, and it will be difficult to put an end to the judicial injustice, which will damage the judicial authority and hinder the improvement of the judicial justice and efficiency.This paper combines the principle of independent trial of judges with the development course of independent trial system of judges in western countries, draws lessons from the advanced nature of the system and constructs an independent trial system of judges in our country in combination with the national conditions of our country.After analyzing the factors influencing the independent trial of judges in our country, the author finds out the judicial defects in the judicial system of our country, and from the aspects of professional management of judges, professional security, responsibility system,Some opinions on the culture of judges and legislative suggestions are put forward.
