我国《刑法》“禁止令”如何才能“令行禁止”——兼论与社区矫正的衔接问题

【摘要】：在社区矫正制度已正式写入《刑法》、《刑事诉讼法》的背景下,社区矫正便是禁止令的最佳归宿。禁止令是针对管制犯、缓刑犯的一种社区矫正措施。禁止令在实践中难以"令行禁止"与我国社区矫正制度与实践的不成熟不无关联。解决禁止令执行困难的问题,还应从禁止令与社区矫正的衔接入手。应当将禁止令纳入社区矫正的考核奖惩制度内,通过明确社区矫正的执行主体、配备专业的工作人员及严格执行禁止令、保证禁止令执行上的公平性等途径来突破禁止令执行上的困境。
[Abstract]:Under the background of community correction system written into Criminal Law and Criminal procedure Law, community correction is the best home of prohibition order. A restraining order is a community correction measure for prisoners and probation offenders. Prohibition order is difficult to prohibit in practice and it is closely related to the immaturity of community correction system and practice in our country. To solve the problem, we should start with the connection between restraining order and community correction. The prohibition order shall be incorporated into the system of assessment, rewards and punishments for community correction, and the prohibition order shall be strictly enforced by making clear the subject of the execution of community correction, providing professional staff, and strictly enforcing the prohibition order. To guarantee the fairness of the execution of restraining orders and other ways to break through the plight of enforcement of restraining orders.
