船舶司法拍卖的性质与法律规制

【摘要】：近年来,由于航运经济不景气导致与船舶有关的纠纷越来越多,与此,在债务人无力偿还债时导致船舶司法拍卖的案例日益增多。船舶司法拍卖作为海事法院及上级法院的一项特殊的业务正在受人关注,本人作为海事法院司法辅助部门的工作人员一直从事着船舶司法拍卖业务,虽然我国有相关的法律法规对船舶司法拍卖业务进行规范,但由于规范不完善,导致实践中各法院执法不统一。为此,本人对船舶司法拍卖的性质、出现的问题及如何进行法律规制探索,以期对今后的审判业务有所碑益。本文分为四大部分,全文结构如下:第一部分,介绍船舶司法拍卖的含义及特点,船舶司法拍卖包含诉讼中和执行中的拍卖。通过与船舶任意拍卖得出船舶司法拍卖具备强制性、公开性、法定性和程序性的特点。第二部分,介绍学术界关于船舶司法拍卖的性质的三种学说以及本人的观点。第三部分,对有关船舶司法拍卖的国际公约及国内规范进行介绍,并分析法律法规在船舶司法拍卖上的适用问题。第四部分,介绍法院司法辅助部门负责的船舶司法拍卖的程序环节,以程序为线索分别从七个方面阐明现行船舶司法拍卖的现行做法及如何进行法律规制和完善。
[Abstract]:In recent years, there are more and more disputes related to ships due to the recession of the shipping economy. In this case, the case of judicial auction of ships is increasing when the debtor is unable to repay the debt. As a special business of the maritime court and the superior court, the maritime judicial auction is being paid attention to. I am the judicial auxiliary Department of the maritime court. The staff have been engaged in the ship judicial auction business. Although the relevant laws and regulations in our country have regulated the ship's judicial auction business, the law enforcement is not uniform due to the imperfect norms. Therefore, I have explored the nature of the judicial auction of the ship and how to carry out the legal regulation. This article is divided into four parts. The text is divided into three parts. The full text structure is as follows: the first part is the introduction of the meaning and characteristics of the ship's judicial auction. The ship's judicial auction contains the proceedings and the auction in the execution. It has the characteristics of mandatory, open, legal and procedural of the ship's judicial auction with the ship's arbitrary auction. The second part introduces the three doctrines and views of the academic circles on the nature of the ship's judicial auction. The third part introduces the international conventions and domestic norms relating to the judicial auction of ships, and analyzes the application of laws and regulations in the judicial auction of ships. The fourth part introduces the ships in charge of the court's judicial assistant department. The procedural link of the ship's judicial auction, with the procedure as the clue, clarifies the current practice of the current ship judicial auction and how to regulate and perfect the legal rules and regulations from seven aspects.
