论我国民事检察权的运行方式与功能承担

【摘要】：抗诉与检察建议是现行法上民事检察权运行的两种方式,民事检察权的功能因运行方式的不同而有不同。抗诉旨在监督审判权,同时通过再审程序发挥着救济当事人的功能,但实际运作中两种功能相互牵制,顾此失彼。只有剔除抗诉的监督功能,将抗诉的功能定位于救济当事人,才能依据当事人主义的要求对抗诉制度加以规制,从根本上保障当事人的私权不受侵犯。而检察建议不受当事人主义的牵绊,也不会侵蚀判决的稳定性及司法裁量权,在监督审判权方面具有天然优势,应通过完善其程序性规定来强化监督效果。
[Abstract]:Protest and procuratorial suggestion are two ways of running civil procuratorial power in current law, and the functions of civil procuratorial power are different from each other. The purpose of the protest is to supervise the judicial power, and at the same time, the retrial procedure plays the role of relief to the litigants, but in the actual operation, the two functions restrain each other and ignore one another. Only when the supervisory function of protest is eliminated and the function of protest is fixed on the relief party can the protest system be regulated according to the requirement of litigant doctrine and the private right of the party be protected from infringement. The procuratorial proposal is not restricted by litigant doctrine, nor will it erode the stability of judgment and judicial discretion. It has a natural advantage in supervising and adjudicating power, and should be strengthened by perfecting its procedural provisions.
