人民法院变更起诉罪名行为的法律规制

【摘要】：人民法院能否变更起诉罪名在我国刑事诉讼法学界颇具争议。现阶段,"以审判为中心"的诉讼制度改革以及认罪认罚从宽制度改革等司法改革措施正在逐步展开,使得人民法院变更起诉罪名又出现新的问题。以司法实务中的具体样态为标准,人民法院变更起诉罪名的模式可分为"由重罪转轻罪"、"由轻罪转重罪"以及"平行变更"3种。对人民法院变更起诉罪名行为的法律规制也应当在不同的变更模式下从实体法与程序法两个层面进行研讨,应正确适用罪数区分理论,充分贯彻罪刑法定原则、控审分离原则与辩护权保障原则。为了增强法律规制的实效,应当完善刑事立法,科学设置罪名,增加"起诉罪名不成立"判决无罪、明确规定人民法院变更起诉罪名的具体形式、细化保障辩护权的相关规定。
[Abstract]:Whether the people's court can change the charge of prosecution is controversial in the field of criminal procedure law of our country. At present, the judicial reform measures, such as the reform of the lawsuit system centered on the trial and the reform of the lenient system of pleading guilty and penalizing, are being carried out step by step, which makes the people's court change the charge of prosecution and bring forth new problems. According to the concrete pattern of judicial practice, the pattern of people's court to change the charge of prosecution can be divided into three types: "from felony to misdemeanor", "from misdemeanor to felony" and "parallel alteration". The legal regulation of the people's court to change the charge of prosecution should also be studied from two aspects of substantive law and procedural law under different changing modes, and the theory of number differentiation of crime should be applied correctly, and the principle of legally prescribed punishment for a crime should be fully implemented. The principle of separation of charge and trial and the principle of safeguarding the right of defense. In order to enhance the effectiveness of legal regulation, we should perfect the criminal legislation, set up the charge scientifically, increase the acquittal of "not guilty of prosecution", clearly stipulate the specific form of the people's court to change the charge of prosecution, and refine the relevant provisions to protect the right to defense.
