司法实践视角下民事公益诉讼的适格原告

【摘要】：民事公益诉讼制度规定以来，一直饱受争议，尤其是对民事公益诉讼适格原告的规定。由于民事公益诉讼原告制度规定的过于笼统以及制度规定本身存在一些问题，造成司法实践中能作为民事公益诉讼的适格原告者少之又少，无法很好地保护公共利益。文章在司法实践视角下，通过真实案例比较和分析民事公益诉讼原告制度存在的问题，并提出完善我国民事公益诉讼的适格原告的建议，，即赋予检察机关和公民个人作为民事公益诉讼的原告资格、扩大社会团体作为民事公益诉讼适格原告的范围和限制行政机关作为民事公益诉讼原告资格的范围。
[Abstract]:Since the regulation of civil public interest litigation system, it has always been controversial, especially for the plaintiff of civil public interest litigation. Because the system of plaintiff in civil public interest litigation is too general and there are some problems in the system itself, there are very few suitably qualified plaintiffs who can act as civil public interest litigation in judicial practice, which can not protect public interests very well. From the perspective of judicial practice, this paper compares and analyzes the problems existing in the plaintiff system of civil public interest litigation through real cases, and puts forward some suggestions on how to perfect the suitable plaintiff in civil public interest litigation in our country. That is to say, the procuratorial organ and individual citizen are endowed with the plaintiff qualification of civil public interest litigation, the scope of social organization as the suitable plaintiff of civil public interest litigation is expanded and the scope of administrative organ being the plaintiff qualification of civil public interest litigation is limited.
