指定居所监视居住措施的功能与适用

【摘要】：指定居所监视居住措施在查办职务犯罪等刑事案件中具有重要的促进和保障功能:一是替代羁押功能;二是加强办案保密功能;三是推动办案功能。该措施具有以下法律特征:法定性;强制性;临时性或者变动性。应当着重从以下方面完善该措施使用机制:确立使用原则;坚持适用标准;规范指定的居所;控制使用的时限;加强协作配合及看管。规范使用该措施须注意以下问题:一是进一步强化初查环节和措施;二是突出抓住看管的关键环节;三是严格依法履行告知义务。
[Abstract]:The residential surveillance measures of designated residence play an important role in promoting and safeguarding the investigation and handling of criminal cases such as job-related crimes. The first is to replace custody; the second is to strengthen the confidentiality of handling cases; and the third is to promote the function of handling cases. The use mechanism of this measure includes: establishing the principle of use; adhering to applicable standards; standardizing the designated residence; controlling the time limit of use; strengthening cooperation and supervision.
