民事诉讼费用交纳标准的设定原理与完善建议

【摘要】：民事诉讼费用交纳标准作为民事诉讼费用制度中的核心部分,同时也是民事诉讼制度顺畅运作的重要保障。通过考察发现,民事诉讼费用交纳标准在实践中存在交纳标准混乱、交纳标准单一、交纳限度不定等问题。以上问题的存在影响了民事诉讼费用交纳标准之基本功能的实现,且与交纳标准的设定原理相悖。因此,明确民事诉讼费用交纳标准的设定原则,对其进行体系化、精细化、合理化设计,乃是完善民事诉讼费用交纳标准的基本路径。
[Abstract]:As the core part of the civil litigation cost system, the standard of paying the civil litigation expenses is also an important guarantee for the smooth operation of the civil litigation system. Through investigation, it is found that the standard of payment of civil litigation expenses is confused in practice, the standard of payment is single, the limit of payment is uncertain, and so on. The existence of these problems affects the realization of the basic function of the standard of payment of civil litigation expenses, which is contrary to the principle of setting the standard of payment. Therefore, it is the basic way to perfect the standard of payment of civil litigation expenses to make clear the principle of setting the standard of payment of civil litigation expenses, to systematize, refine and rationalize the design of the standard.
