公安机关运用技术侦查措施的相关程序性问题

【摘要】：关于技术侦查措施存在的诸多问题有学者在不断地探讨和研究,在理论完善和指导实践中起到了积极的作用。然而事实上,侦查机关在运用技术侦查措施的过程中,已经摸索出来较为完备的操作流程和规范,并制定了相应的内部操作规范,在其中对技术侦查措施具体应用中可能遇见的相关法律关系进行了界定,并且规定了相应的法律责任。尽管如此,侦查机关在运用技术侦查措施的过程中,仍存在些许问题或者实践中的疑惑。虽然学界对如何规范技术侦查等相关法律问题进行了多维的探讨,但结论却未必能够直接解决实践中存在的问题,因为对实践缺乏深入了解,提出问题和解决办法难免有隔靴搔痒之惑。本文在学习和借鉴学者们的成果和观点的同时,结合笔者自身工作经验,提出技术侦查措施运用过程中存在的问题和一些困惑,以期对症下药,在一定的时间内、在遵循现有刑事诉讼法规范的前提下,进一步对技术侦查措施进行规范。本文共包含三个部分的内容:第一部分是介绍技术侦查措施的现有规范体系及运行现状。首先,介绍了我国现有技术侦查措施的规范。其次,通过与国外对技术侦查措施定义的比较结合自身工作实践,探讨了技术侦查措施的概念界定。第三,以侦查员的视角对我国技术侦查措施运行模式做以介绍。第二部分立足实践,分别对技术侦查措施运行过程中的申请、审批和执行环节进行剖析,提出并分析技术侦查措施在运行过程中存在的现实问题。第三部分对技术侦查措施在实践中存在的问题提出了几点不成熟的构想。主要从总体完善和具体运用这两个层面对解决技术侦查措施存在的程序性问题予以构思和完善。
[Abstract]:Many problems about technical investigation measures have been discussed and studied by scholars, which have played an active role in improving theory and guiding practice. However, in fact, in the process of using technical investigation measures, the investigative organs have found out more complete operating procedures and norms, and have formulated corresponding internal operational norms. In which the technical investigation measures may be met in the specific application of the definition of the relevant legal relations, and the corresponding legal responsibility. However, there are still some problems or doubts in the process of applying technical investigation measures. Although scholars have carried out multidimensional discussions on how to standardize technical investigation and other related legal issues, the conclusions may not be able to directly solve the problems existing in practice, because of the lack of in-depth understanding of the practice. It is inevitable to put forward problems and solutions. This paper, while studying and drawing on the achievements and viewpoints of scholars and combining the author's own work experience, puts forward some problems and some puzzles in the application of technical investigation measures, with a view to finding the right remedy for the case in a certain period of time. On the premise of following the existing criminal procedure law, the technical investigation measures are further standardized. This paper includes three parts: the first part is to introduce the existing standard system and operation status of technical investigation measures. First of all, it introduces the existing technical investigation measures in China. Secondly, the definition of technical investigation measures is discussed by comparing with the definition of technical investigation measures in foreign countries. Third, the author introduces the operation mode of technical investigation measures in China from the perspective of investigators. The second part, based on practice, analyzes the application, examination and approval and execution of technical investigation measures, and puts forward and analyzes the practical problems existing in the operation of technical investigation measures. The third part puts forward some immature ideas about the problems existing in the practice of technical investigation measures. Mainly from the overall improvement and concrete application of these two levels to solve the procedural problems of technical investigation measures to be conceived and improved.
