认罪认罚从宽语境下职务犯罪案件协商机制的构建

【摘要】:在司法体制和监察体制改革叠加的框架内,构建职务犯罪认罪协商机制是效率与公正的客观需要,是完善认罪认罚从宽制度的重要选择,是监察体制改革语境下实现审前分流与分化的必然要求,符合现行法律规定的精神,也有域内外的实践可资借鉴。检察机关针对职务犯罪案件开展认罪认罚协商前,要厘清制度定位、证明标准适用等前置问题,以认罪、认罚为基本前提要件,将监察委员会移送至检察机关审查起诉的涉嫌职务犯罪案件纳入协商程序。破除案件性质和罪行轻重的范围限制,从程序启动、认罪认罚、权利义务、风险防范等具体事项切入,对职务犯罪认罪认罚协商机制的基本方面进行建构,使该制度能够实现法、理与实践上可操作性的有机统一,以顺应提高打击职务犯罪效率、节约司法资源的现实需要。
[Abstract]:Within the framework of the superposition of the reform of the judicial system and the supervisory system, it is an objective need for efficiency and justice to construct a plea bargaining mechanism for duty crimes, which is an important choice to perfect the lenient system of guilty admission and punishment. It is an inevitable requirement to realize the diversion and differentiation of pretrial trial in the context of supervisory system reform. It conforms to the spirit of the current legal provisions and can also be used for reference by the practice inside and outside the field. The procuratorial organs should clarify the system orientation, the application of the standard of proof, and so on before the negotiation on admission of guilt and punishment in the case of job-related crimes, and take the admission of guilt and the admission of punishment as the basic prerequisite. To include in the consultation procedure cases of suspected job-related crimes transferred by the supervisory committee to the procuratorial organ for prosecution. To break the limitation of the nature of the case and the severity of the crime, from the start of the procedure, the admission of guilt and punishment, the rights and obligations, the risk prevention and other specific matters, to construct the basic aspects of the consultation mechanism for the recognition and punishment of job-related crimes. The system can realize the organic unification of law, principle and practice, in order to meet the practical need of improving the efficiency of attacking duty crime and saving judicial resources.
