比较法视阈下我国大陆地区小额诉讼程序的新图景

【摘要】：小额诉讼程序是2012年《民事诉讼法》再次修改后新增加的一个程序,旨在更好地实现案件的繁简分流。但是目前现实中"遇冷"的状况与立法者的初衷颇有不符。基于美、英、日、我国台湾地区有关小额诉讼程序在审判组织、当事人的程序选择权、具体程序运行以及救济途径等问题上的相对成熟的规定,我国大陆地区应当整合小额诉讼程序的审判组织;根据救济机制的完善决定是否赋予当事人以适用小额诉讼程序的程序选择权,限制合意适用该程序的标的额上限以及同一年内利用的次数;在调解、起诉方式、开庭日期、审限以及执行等领域进行契合小额诉讼程序特点的改革;在保留现有再审途径的前提下增设异议程序来强化对当事人的救济。
[Abstract]:The small claims procedure is a new procedure after the revision of the Civil procedure Law in 2012, in order to better realize the complicated and diffused cases. But the current situation of "not as expected" is quite inconsistent with the original intention of the legislator. Based on the relatively mature provisions of the United States, the United Kingdom, Japan, and the Taiwan region on the trial organization, the procedural options of the parties, the operation of the specific procedure and the way of relief, etc. China's mainland should integrate the trial organization of the small claims procedure; (B) according to the perfection of the relief mechanism, whether to grant the parties the right to choose the procedure for the application of the small claims procedure, and to limit the limit of the amount of the object of the agreed application of the procedure and the number of times used in the same year; In the fields of mediation, prosecution, court date, trial limit and execution, the reform of the characteristics of small claims procedure is carried out; on the premise of retaining the existing ways of retrial, the dissenting procedure is added to strengthen the relief to the parties.
