论民事案件的上诉审裁判方式——兼论新《民事诉讼法》关于上诉审裁判方式的规定

【摘要】：上诉审裁判方式是司法政策与司法技术的综合体,与其较为相似的概念是"上诉审裁判",但这两个概念是有所区别的,应当为上诉审裁判方式作出明确的学理定义。在对上诉案件作出结论性意见之后,还有一个裁判方式的选择问题,这取决于审级架构模式等因素的影响、相关理念的指导和对法律规定的正确理解。我国新《民事诉讼法》关于上诉审裁判方式的规定还有可商榷之处。
[Abstract]:The mode of appellate adjudication is a combination of judicial policy and judicial technology, and the similar concept is "appellate adjudication", but these two concepts are different from each other, and a clear theoretical definition should be made for the way of appellate adjudication. After concluding observations on the appeal case, there is also a question of how to choose the decision mode, which depends on the influence of factors such as the mode of trial-level structure, the guidance of related concepts and the correct understanding of the provisions of the law. The provisions of the new Civil procedure Law of our country on the way of appellate adjudication are still open to discussion.
