认真对待诉讼心理——论“案结事了”语境下我国诉讼辅导制度的重塑

【摘要】:正中国法院2011年的案件上诉率为25.12%,申诉率为1.01%,信访投诉率为1.36%,考虑到全国近千万件的案件总数,25.12%的上诉率、1.01%的申诉率和1.36%的信访投诉率及其隐含的案结事未了的纠纷解决成本显然不是一个小数。〔1〕本文试图从诉讼心理的角度来对纠纷解决、案结事了提供一个新视角,并主张通过建立全面、中立、多元的诉讼辅导制度来促进最大限度的案结事了。
[Abstract]:In 2011, the appeal rate of Chinese courts was 25.12%, the appeal rate was 1.01%, and the complaint rate of letters and visits was 1.36%. Taking into account the total number of cases involving nearly 10 million cases in the country, and the appeal rate of 25.12%, The complaint rate of 1.01% and the complaint rate of 1.36% and the implicit unsolved dispute settlement cost are obviously not a decimal number. (1) this paper attempts to resolve the dispute from the perspective of litigation psychology. The conclusion of the case provides a new perspective and advocates the establishment of a comprehensive, neutral and pluralistic litigation guidance system to promote maximum settlement of the case.
