认真对待诉讼心理——论“案结事了”语境下我国诉讼辅导制度的重塑

【摘要】：正中国法院2011年的案件上诉率为25.12%,申诉率为1.01%,信访投诉率为1.36%,考虑到全国近千万件的案件总数,25.12%的上诉率、1.01%的申诉率和1.36%的信访投诉率及其隐含的案结事未了的纠纷解决成本显然不是一个小数。〔1〕本文试图从诉讼心理的角度来对纠纷解决、案结事了提供一个新视角,并主张通过建立全面、中立、多元的诉讼辅导制度来促进最大限度的案结事了。
