非法证据排除争议的程序构建

【摘要】：非法证据排除程序既不属于刑事诉讼中实体性争议程序,也不属于单纯诉讼性争议程序,而应归属于因程序性纠纷引发的混合性诉讼争议程序。其主要特征表现为:其一,它以诉讼活动的存在为前提,没有刑事诉讼,就不能出现因诉讼行为引起的纷争。其二,它具有程序性违法行为和实体性违法行为并存的特性。其三,它在启动时间、诉讼构造、参与主体、审查原则、决定主体、裁定形式、救济程序等方面有特殊性。因此,设计该程序时要注意几点:一是此类纠纷应当在审判阶段解决;二是该程序主要解决侦查机关取证行为合法性问题,其具体的启动、程序结构等环节要突出司法性;三是其应以"上诉"方式对当事人的诉讼权利予以救济。
[Abstract]:The exclusion procedure of illegal evidence does not belong to the substantive dispute procedure in criminal proceedings, nor does it belong to the simple procedural dispute procedure, but should belong to the mixed litigation dispute procedure caused by procedural disputes. Its main characteristics are as follows: first, it is based on the existence of litigation activities, without criminal proceedings, there can be no disputes caused by litigation. Second, it has the characteristics of the coexistence of procedural illegal acts and substantive illegal acts. Third, it has particularity in starting time, litigation structure, participating subject, examination principle, determining subject, ruling form, relief procedure and so on. Therefore, when designing the procedure, we should pay attention to several points: first, this kind of dispute should be settled in the trial stage; second, the procedure mainly solves the legality of the evidence collection behavior of the investigation organ, and its specific start-up, procedure structure and other links should highlight the judicial nature; Third, it should provide relief to the litigants' litigation rights by means of "appeal".
