【摘要】：罪犯顺利回归社会不再犯罪是刑罚执行的最终目标,但是我国传统的报复主义思想过于严重,导致监狱改造罪犯和社区矫正罪犯面临着很大困难。本文通过对监狱和社区改造罪犯的思想、方法、管理人员素养及罪犯出狱后的保护制度等多方面进行了研究,并提出了合理化建议,促进罪犯的再社会化进程。本文除前言外共分为五个部分:第一部分:罪犯再社会化概述本章首先对罪犯、社会化、社区矫正等相关概念进行了解释,便于文章的理解,其次又对罪犯再社会化国内外思想的产生过程及发展现状进行了阐述。最后对罪犯再社会的意义和特征进行了论述。第二部分:罪犯再社会化的可行性本章对监狱和社区罪犯再社会化可行的基础条件进行了解读,从法规制度、社会环境以及探索经验等几个方面论证了罪犯再社会化具有可行性。第三部分:我国罪犯再社会化现状本章首先对监狱罪犯再社会化面临分布不合理、刑罚执行封闭、教育改造简单、人员素质参差不齐、非监禁刑发展滞后等五个方面的的问题进行了描述及分析,其次对社区服刑罪犯再社会化面临思想观念落后、社区矫正滞后、法律不健全、人员专业性差等四个方面进行了分析。最后对出狱人保护制度的薄弱问题进行了简单的描述。第四部分:我国罪犯再社会化制度构建本章对罪犯再社会化面临的问题提出了合理化建议,一方面是对监狱的改革:要合理化监狱布局、推进开放式处遇、教育改造要社会化、建立专业化的监狱警察队伍、发展非监禁刑等;另一方面是对社区矫正的改革:建立正确社区矫正观念、推进现代社区建设、《制定社区矫正法》、建立专业社区矫正队伍等。最后对出狱保护制度进行了完善化建议。第五部分:结论本章对全文进行了总结,罪犯再社会化是一项复杂庞大的工程,我国需要从实际出发,从观念、立法、制度、技术等多方面进行改革,不断完善我国罪犯再II社会化制度。社会化制度。
[Abstract]:Criminals return to society without any crime is the ultimate goal of penalty execution, but our traditional retaliation ideology is too serious, which leads to great difficulties in prison reform criminals and community corrections criminals.
