【摘要】：考试舞弊,自古有之。我国当今的社会生活中,考试舞弊这一严重破坏考试规则,影响选拔人才公平公正的现象日渐猖獗,并且有着愈演愈烈之态势。这一行为的出现不仅对社会的公信力和人们心中公平公正理念有着极大的冲击和撼动,还破坏着国家考试的秩序和选拔人才的制度。考试舞弊具有严重社会危害性,应该引起全社会广泛关注,具体刑法也理应对其进行规制。随着立法的不断完善,考试舞弊行为也将受到法律的制约。二O一五年八月二十九日正式通过的《中华人民共和国刑法修正案(九)》首次将考试舞弊行为入罪,开启了我国将考试舞弊纳入犯罪的新阶段。本文主要从以下三部分对考试舞弊行为犯罪化问题展开详细讨论：第一部分,考试舞弊罪的境外立法考察,包括大陆法系考试舞弊罪的立法考察、英美法系考试舞弊罪的立法考察、港澳台地区考试舞弊罪的立法考察以及他们对完善我国考试舞弊罪的借鉴意义。这一部分是展开考试舞弊行为犯罪化研究的前提。第二部分,考试舞弊罪的犯罪构成,分别从犯罪主体、犯罪主观方面、犯罪客体、犯罪客观方面展开论述。第三部分,考试舞弊罪的司法实践,研究考试舞弊的罪与非罪、考试舞弊罪的阶段形态、共犯形态及罪数形态。
[Abstract]:Examination fraud has existed since ancient times. In our country's current social life, examination fraud seriously destroys the examination rules and affects the fair and just selection of talents. The emergence of this behavior not only has a great impact on the credibility of society and the concept of fairness and justice in people's hearts. It also destroys the order of the national examination and the system of selecting talents. Examination fraud has serious social harmfulness and should cause widespread concern of the whole society. The specific criminal law should also regulate it. With the continuous improvement of legislation. Examination fraud will also be restricted by law. The Criminal Law Amendment (9) of the people's Republic of China, adopted on August 29th 15, criminalizes examination fraud for the first time. This paper mainly discusses the criminalization of examination fraud from the following three parts: the first part, the examination fraud crime overseas legislation investigation. Including the civil law system examination fraud crime legislation investigation, the common law system examination fraud crime legislation investigation. The legislative investigation of the examination fraud in Hong Kong, Macao and Taiwan and their reference significance to perfect the examination fraud crime in our country. This part is the premise of the research on the criminalization of examination fraud. The second part. The constitution of the crime of fraud in examination is discussed from the subject of crime, subjective aspect of crime, object of crime and objective aspect of crime. The third part is the judicial practice of the crime of examination fraud, and studies the crime and non-crime of examination fraud. The stage form, accomplice form and crime number form of the crime of fraud in examination.
