【摘要】：随着刑事审判案件的多元化和复杂化,依法量刑与公正量刑之间的冲突日臻显现,判决对于形式化和量化的过度追求致使规范外的价值评价因素被忽略,进而使得量刑因价值判断的缺失而偏离公正的轨道。因而,必须深刻明晰价值判断在量刑中的重要意义,合理化解依法量刑和公正量刑之间的关系,才能实现使得量化契合社会大众的期望。为此,本文从价值判断与公正量刑的关系入手,并对公正量刑的实现路径进行探究,以期为科学化量刑体系的构建提供可行借鉴。
[Abstract]:With the diversification and complexity of criminal trial cases, the conflict between sentencing according to law and fair sentencing becomes more and more obvious, and the excessive pursuit of formalization and quantification results in the neglect of value evaluation factors outside the norms. Therefore, it is necessary to clarify the significance of value judgment in sentencing and reasonably resolve the relationship between sentencing according to law and just sentencing. Therefore, this paper starts with the relationship between value judgment and fair sentencing, and probes into the realization path of fair sentencing. In order to provide a feasible reference for the construction of scientific sentencing system.
