贪污罪认定中应注意的几个问题

【摘要】：随着社会经济的不断发展与反腐力度的不断加大,贪污腐败现象层出不穷,上至省部级高官下至乡科级普通干部,一个个前赴后继,从人民公仆走向人民群众的对立面。为有效打击贪污罪,学术界对贪污罪构成要件的研究从未中断,本人从事刑事审判工作以来,主要审理包括贪污罪在内的经济类犯罪,本文站在一个法官的角度,从贪污罪的主体、利用职务之便、犯罪对象三个方面对贪污罪进行研究,期望对今后的刑事审判工作有所裨益。本文共五个部分,共约2.8万字。第一部分：引言。简要阐明了本文的研究方向及范围。第二部分：认定贪污罪的犯罪主体方面应注意的问题。从以下四个大的方面进行阐述。 (一)对国家工作人员的认定 1.对国家机关工作人员的认定 2.对国有公司、企业、事业单位、人民团体中从事公务人员的认定 3.对国家机关、国有公司、企业、事业单位委派到非国有公司、企业、事业单位、社会团体中从事公务人员的认定 4.其他依照法律从事公务人员的认定 (二)受国家机关、国有公司、企业、事业单位、人民团体委托管理、经营国有财产人员的认定 (三)共犯 (四)通过伪造证件等手段担任国家工作人员职务后侵占本单位财务的认定第三部分：认定利用职务之便应注意的问题。本部分主要分析了什么是职务、职务行为,在具体认定中应注意的问题等几个方面进行了分析。第四部分：认定贪污罪的犯罪对象应注意的问题。本部分从传统意义上的公共财产到目前司法实践中出现的赃物、违禁品、不动产、混合所有制经济组织的财产、财产性利益几个方面进行了研究。第五部分：结语。本部分以一个法官的角度作了一个表态性的收尾。
[Abstract]:With the continuous development of social economy and the continuous increase of anti-corruption efforts, corruption has emerged in endlessly, from the provincial and ministerial level of senior officials to the township level of ordinary cadres, one after another. From the people's public servants to the opposition of the masses. In order to effectively combat corruption, academic research on the constitutive elements of corruption has never been interrupted, I have been engaged in the criminal trial work. The main trial of economic crimes, including corruption, including the crime, this article stands in the perspective of a judge, from the main body of corruption crime, the use of the position of the crime, the crime of three aspects of the crime of corruption. It is expected to benefit the criminal trial in the future. There are five parts in this paper, a total of about 28,000 words. The first part: introduction. Identification of other public officials acting in accordance with the law (2) the identification of personnel who are entrusted by state organs, state-owned companies, enterprises, institutions and people's organizations to operate state-owned property (III) accomplices (4) the determination of encroachment on the financial affairs of the unit after holding the post of state functionary by means of forgery of certificates, etc. The third part is about the problems that should be paid attention to. This part mainly analyzes what is the position, the behavior of the post, and the problems that should be paid attention to in the concrete identification. Part 4th: problems to be paid attention to in determining the target of corruption crime. This part from the traditional sense of public property to the current judicial practice of stolen goods, contraband, real estate. The property and property interests of economic organizations under mixed ownership are studied in several aspects. Part 5th: conclusion. This part concludes with a statement from a judge's point of view.
