国际禁毒公约视角下我国惩治毒品犯罪的法律研究

【摘要】：毒品犯罪作为一种国际犯罪,像瘟疫一样在全球各地蔓延开来,几乎每一个国家都遭到了毒品的侵袭,严重威胁人类的身体健康和心理健康发展,与此同时,由毒品引发的各类犯罪也不断增多,极大地破坏了社会的和谐与稳定。毒品被视为危害人类发展的全球性公害之一,打击毒品犯罪是全世界人民共同关心的话题。中国自古就受到毒品的侵害,中国人民对于毒品更是深恶痛绝,打击并消灭毒品犯罪是大部分中国人的心愿。但是,打击毒品犯罪是一项十分艰难的工作,由于受到国内国外各个因素的制约,毒品犯罪在我国呈现出从基本被消灭到日渐猖狂,危害的范围由局部到全国,原来以过境贩毒为主,现在发展为国内消费与过境贩毒并存,毒品种类从传统毒品过渡到新型毒品,并且集制造、贩卖与滥用于一体,已经被打败的毒品问题又悄然来袭。并且呈现出境外毒源“多头入境,全线渗透”,对我国危害日趋严重;吸毒人数逐年增加,青少年市场日益庞大;毒品种类日益多元,新型毒品犯罪突出;制毒贩毒活动猖獗,易制毒化学品大量流入非法渠道;吸毒危害后果严重,引发各种社会问题等特点。本文通过对三个重要的国际禁毒公约和国外典型国家在惩治毒品犯罪方面的规定进行探讨和借鉴,立足于中国的实际情况,在完善中国关于禁毒方面的相关立法,科学执法,并广泛的开展国际合作等方面提出建议,以期对打击毒品犯罪,遏制并最终消灭毒品犯罪有所裨益。本文共分为五部分。第一部分,引言。介绍了选题的背景及意义、国内外在该领域的研究现状和主要的研究方法及创新点。第二部分首先介绍了毒品的概念,进而提出毒品犯罪的概念,从国内和国际两个方面阐释了毒品犯罪现实的严峻状况。第三部分研究了国际社会和域外惩治毒品犯罪的立法,立足于国际上三个重要的禁毒公约和其他主要国家在惩治毒品犯罪方面先进的立法措施,并对此进行了概括总结。第四部分,承上启下,在第三部分的基础上介绍了我国早期毒品犯罪的立法、现行刑法以及禁毒法中有关惩治毒品犯罪的规定,并阐述了我国禁毒执法现状和国际禁毒合作现状,进而提出我国惩治毒品犯罪方面存在的问题和不足。第五部分,在国际禁毒公约的视角下提出我国惩治毒品犯罪的法律思考,从立法和执法两方面来提出完善我国惩治毒品犯罪的法律建议,并提出打击毒品犯罪应不断加强国际合作。
[Abstract]:Drug crime, as an international crime, has spread all over the world like the plague. Almost every country has been attacked by drugs, which seriously threatens the physical and mental health of human beings, while at the same time. All kinds of crimes caused by drugs have also been increasing, which has greatly damaged the harmony and stability of society. Drugs are regarded as one of the global public hazards endangering the development of human beings. Cracking down on drug crimes is a topic of common concern to the people of the world. China has been invaded by drugs since ancient times, and the Chinese people are deeply loathing about drugs. It is the wish of most Chinese people to crack down on and eliminate drug crimes. However, cracking down on drug crimes is a very difficult task, which is restricted by various factors at home and abroad. Drug crimes in our country from the basic elimination to the increasingly rampant, the scope of harm from local to national, originally mainly to transit drug trafficking, now developed for domestic consumption and transit drug trafficking co-exist. From traditional drugs to new types of drugs, and set manufacturing, trafficking and abuse in one, has been defeated by the drug problem quietly, and presents a foreign drug source "multiple entry, the whole line of penetration." The harm to our country is becoming more and more serious; The number of drug users is increasing year by year, and the youth market is becoming larger and larger. The variety of drugs is becoming more and more diverse, and the new drug crime is prominent; Drug manufacturing and drug trafficking are rampant, and precursor chemicals are flowing into illegal channels in large quantities; Drug abuse has serious consequences and causes various social problems. This paper discusses and draws lessons from the three important international drug control conventions and the regulations of foreign typical countries in punishing drug crimes. Based on the actual situation in China, in the improvement of China's anti-drug related legislation, scientific law enforcement, and extensive international cooperation, and so on, in order to combat drug crimes. This paper is divided into five parts. The first part introduces the background and significance of the topic. Domestic and foreign research in this field, the main research methods and innovative points. The second part introduces the concept of drugs, and then puts forward the concept of drug crime. The third part studies the legislation of the international community and the extraterritorial punishment of drug crimes. Based on the three important international drug control conventions and other major countries in the punishment of drug crime advanced legislative measures, and summarized this part. 4th, connecting with the preceding and the following. On the basis of the third part, it introduces the legislation of our country's early drug crime, the current criminal law and the provisions of anti-drug law about punishing drug crime, and expounds the current situation of drug law enforcement and international drug control cooperation in our country. Then it puts forward the existing problems and deficiencies in punishing drug crimes in China. Part 5th puts forward the legal thinking of punishing drug crimes in China from the perspective of international drug control conventions. From the aspects of legislation and law enforcement, the author puts forward some legal suggestions to perfect our country's punishment of drug crimes, and puts forward that international cooperation should be continuously strengthened in the fight against drug crimes.
