规范性构成要件要素的故意及错误——以赵春华非法持有枪支案为例

【摘要】:在赵春华非法持有枪支案中,二审法院与辩护律师的争议之一在于赵春华是否具备犯罪故意。我国刑法明确规定了一个实质的犯罪故意概念,该犯罪故意不仅包含构成要件故意,而且包含罪责故意与不法意识(社会危害性认识)。认定赵春华具备非法持有枪支的故意,首先必须证明其对于"枪支"这一规范性构成要件要素具备完全的意义认识,但从本案的案情来看,根据"外行人领域的平行评价标准",赵春华缺乏这一意义认识,因此成立构成要件错误,从而排除故意;其次必须证明其对于"违反枪支管理规定"这一空白构成要件要素存在明知,但从案情来看,这一明知也无法成立。即使认定赵春华对于"违反枪支管理规定"存在明知,其也可以援引不可避免的禁止错误为其出罪。
[Abstract]:In the case of illegal possession of firearms by Zhao Chunhua, one of the disputes between the court of second instance and the defense lawyer is whether Zhao Chunhua has criminal intent. The intention of the crime not only includes the elements of intent, but also includes the intention of crime and responsibility and the consciousness of lawlessness (social harmfulness cognition). Zhao Chunhua is found to have the intention of illegally holding guns. First of all, it must prove that it has a complete meaning for the "firearm" as a normative component element, but from the case of the case, according to the "parallel evaluation criteria in the field of layman". Zhao Chunhua lacks this meaning cognition, therefore establishes the constitution element mistake, thus excludes intentionally; Secondly, it must prove its knowledge of the "violation of firearms regulation" as a blank constitutive element, but from the point of view of the case. Even if Zhao Chunhua was found to have knowledge of "violating gun regulations," he could invoke the inevitable prohibition of error as a crime.
