腐败惩罚的边际递减及地区差异:基于腐败金额的实证分析

【摘要】：基于2014年中国法院公布的受贿罪一审判决文书,实证探讨腐败金额对惩罚力度的影响。使用法院对受贿罪的判刑时间作为腐败惩罚力度的衡量指标,实证分析发现:腐败金额越多,判刑时间越长,但判刑增加的力度随着腐败金额的增加而减少,惩罚力度呈现出边际递减现象;同时,惩罚力度还呈现出地区差异,当腐败金额不断增加时,判刑增加的力度随着人均收入水平的增加而减少,东部地区比中西部地区判决更轻,但惩罚没有显著的城乡差异。要降低惩罚的边际递减影响,需提高惩罚概率、丰富惩罚类型、适度降低腐败金额与惩罚力度之间的关联。
[Abstract]:Based on the documents of first instance judgment on the crime of accepting bribes published by Chinese courts in 2014, this paper empirically discusses the influence of the amount of corruption on the severity of punishment. Using the time of sentencing of the crime of accepting bribes by the court as a measure of the severity of punishment for corruption, The empirical analysis shows that: the more the amount of corruption, the longer the sentence, but the increase of the penalty decreases with the increase of the amount of corruption, and the punishment shows marginal decline, meanwhile, the severity of punishment also shows regional differences. When the amount of corruption continues to increase, the increase in sentences decreases with the increase in per capita income levels. The eastern region has a lighter sentence than the central and western regions, but there is no significant difference in punishment between urban and rural areas. The marginal diminishing impact of punishment should be reduced. It is necessary to increase the probability of punishment, enrich the types of punishment, and appropriately reduce the correlation between the amount of corruption and the severity of punishment.
