刑事禁止令适用中的问题研究

【摘要】:2011年11月25日出台的《中华人民共和国刑法修正案(八)》(以下简称《刑修(八)》)对我国的非监禁刑进行了较大的调整,其中规定了一种崭新的制度,即刑事禁止令制度。禁止令是刑罚制度的一个创新,该制度的设立推进了我国行刑社会化进程。学界认为,从我国新增加刑事禁止令制度可以看出,宽严相济的刑事政策在我国得以逐渐确立。禁止令制度的确立不仅丰富了我国的刑罚执行体系,更增添管制犯与缓刑犯的监管方式,并对扩大非监禁刑在刑罚适用中的比例起到了一定的推动作用。自《刑修(八)》出台后的一个月内,该制度被井喷式地附加于各种管制、缓刑制度,而后却出现适用数量大量下滑的局面。执行不力可能是造成这种局面的主要原因。禁止令的现行规定过于笼统,缺乏明确的适用标准也在一定程度上加剧了执行难度。因此,本文在认可刑事禁止令作为一种刑罚执行制度的基础上,引用现实案例来说明,法院在判处禁止令环节及禁止令执行环节存在的问题,应当予以关注并解决。笔者把发现的问题概括为判决标准不明确与缺乏专门执行机关两方面。针对审判机关判决标准不明确这一问题,笔者引入各法院的实际判例来说明现状,并借鉴国际经验与我国山东省的试点成果提出了相应的解决方案。针对缺乏专门的执行机构这一问题,本文梳理了我国有关于此的立法尝试与执行状况。借鉴运用非监禁刑较为发达地区的社区矫正体制。从审前风险评估与建设专门的社区矫正执行机关这两个方面对禁止令执行问题进行了详细的制度构建。目前针对禁止令适用问题研究并不丰富,学界更多研究主要集中在禁止令的性质定性上。如此,使得判决适用禁止令的问题没能得到关注。在执行环节的研究中,现有的探索主要集中于各部门之间的协作配合上,缺乏对建立一支专门队伍迫切性的认识。本文着力于对上述研究较为空白的方面,尤其是在审前风险评估与禁止令执行机关的内部设计上进行了大胆的尝试。
[Abstract]:In November 25th 2011, the Criminal Law Amendment (8) of the people's Republic of China (hereinafter referred to as "Criminal Amendment (8))" made a great adjustment to the non-custodial punishment in our country, which stipulated a new system. That is, the criminal prohibition order system. The prohibition order is an innovation of the penalty system, and the establishment of this system has promoted the socialization process of execution of punishment in China. The academic circles believe that the new criminal prohibition order system can be seen from the addition of the criminal prohibition order system in our country. The criminal policy of combining leniency and severe punishment has been gradually established in our country. The establishment of prohibition order system not only enriches the penalty enforcement system of our country, but also increases the way of supervision of the prisoners and probation offenders. And it has played a certain role in promoting the expansion of the proportion of non-custodial punishment in the application of penalty. Within one month after the introduction of "Criminal repair (8)", this system has been added to various systems of control and probation in a blowout manner. Then there is a significant decline in the number of applications. The lack of enforcement may be the main cause of this situation. The existing provisions of the prohibition order are too general and the lack of clear applicable criteria has to some extent made the implementation more difficult. Based on the recognition of the criminal prohibition order as a penalty enforcement system, this paper cites a practical case to illustrate the problems of the court in sentencing the prohibition order and the execution of the prohibition order. It should be paid attention to and solved. The author generalizes the problem as two aspects: the judgment standard is not clear and the specialized executive organ is lacking. In view of this problem, the author introduces the actual case law of each court to explain the present situation. And draw lessons from the international experience and the pilot results of Shandong Province, put forward the corresponding solutions. This article combs the legislative attempt and the implementation situation of this in our country. Draws lessons from the use of non-custodial punishment in the more developed areas of the community correction system. From the pretrial risk assessment and the construction of specialized community correction executive organs these two aspects. This paper has carried on the detailed system construction to the prohibition order execution question. At present, the research on the prohibition order application question is not rich, More research in academic circles mainly focuses on the nature and nature of restraining orders. As a result, the application of injunctive orders by judgments has not been paid attention to. In the study of execution, the existing exploration mainly focuses on the cooperation and coordination among various departments. There is a lack of understanding of the urgency of establishing a specialized team. This paper focuses on the blank aspects of the above research, especially on the internal design of the pre-trial risk assessment and restraining order enforcement agencies.
