【摘要】：随着我国城市化脚步的进一步加快,城市改造建设的力度也逐渐加大。由于拆迁政策牵涉环节众多且背后隐藏着庞大的经济利益,城市拆迁领域已然成为贪污贿赂等职务犯罪的“衍生区”,拆迁问题更是成为我国城市管理问题集中爆发的焦点之一。从理论上看,遍及全国的城市拆迁问题亟需系统的理论指导和法律依据,以保证拆迁工作合理、合法、有序的进行。而如今有关城市拆迁中的职务犯罪问题的分析与归纳并不多见,尚不足以为我国惩治此类犯罪提供法学理论上的支持。由此可见,本选题具有广阔的应用前景,可在一定程度上满足这方面的需求。从实践上看,厘清城市拆迁中职务犯罪的一般规律和特点,可为新时期城镇化建设中的拆迁工作扫清障碍,为国家的全面发展减轻阻力。因此,要定位好政府的角色,处理好与开发商、被拆迁人及第三方的关系,进而减少拆迁中的职务犯罪。作为特定领域内存在的一种新型违法犯罪形式,城市拆迁领域的职务犯罪具有极大的危险性。针对当前城市拆迁愈演愈烈以及与之相对应的职务犯罪居高不下的状况,本选题结合职务犯罪的一般理论和全国各地的拆迁案例,对有关理论和问题进行了深入研究,将论文内容大致分为以下四个部分:第一章,以具体案例作为切入点,讲述案情并进行案例分析,进而引发对整个案件的思考。第二章是对拆迁制度和职务犯罪相关基本理论的研究和概述,根据整个拆迁制度的立法沿革及相关案例和文献,对有关理论和概念进行了界定,并归纳总结了城市拆迁中职务犯罪的特点、类型、行为方式、多发环节和危害性。第三章是对城市拆迁中职务犯罪产生的原因进行分析。客观原因方面,城市化进程的急速发展、拆迁机构设置的不合理及拆迁程序的不规范;暗箱操作、不透明的拆迁工作机制以及监督体制的不完善更纵容了城市拆迁中职务犯罪的发生;同时,法制建设的滞后性也为城市拆迁领域职务犯罪的蔓延提供了可乘之机。主观原因方面,由于拆迁人员法制观念淡薄、素质不高,官商勾结,拆迁领域“潜规则”盛行,加之传统关系社会、人情社会等不良因素的影响,都为城市拆迁中的职务犯罪造就了滋生土壤。第四章是预防城市拆迁领域职务犯罪的法律对策建议。文章从立法、司法方面提出治理对策建议,拟找出一条能够减少当前城市拆迁中职务犯罪几率的道路。
[Abstract]:With the further acceleration of urbanization in our country, the intensity of urban reconstruction and construction has gradually increased. Because of the numerous links involved in the demolition policy and the huge economic benefits hidden behind it, The field of urban demolition has become the "derivative zone" of official crimes such as corruption and bribery, and the problem of demolition has become one of the focal points of the urban management problems in China. The problem of urban demolition all over the country needs systematic theoretical guidance and legal basis in order to ensure that the work of demolition is carried out reasonably, legally and orderly. But nowadays, the analysis and induction of the problem of duty crime in urban demolition is rare. It is not enough to provide the legal theory support for our country to punish this kind of crime. Therefore, this topic has the broad application prospect, may satisfy the demand of this aspect to a certain extent. From the practical point of view, By clarifying the general laws and characteristics of job-related crimes in urban demolition, we can clear the way for the demolition and relocation work in the new period of urbanization construction, and alleviate the resistance for the overall development of the country. Therefore, we should position the role of the government well and handle well with the developers. The relationship between the person removed and the third party, thus reducing the duty crime in the demolition. As a new type of illegal crime in a specific field, The duty crime in the field of urban demolition is extremely dangerous. In view of the current situation that the urban demolition is becoming more and more serious and the corresponding job-related crimes remain high, this topic combines the general theory of duty crime and the cases of demolition in various parts of the country. The thesis is divided into the following four parts: the first chapter, taking the concrete case as the breakthrough point, narrates the case and carries on the case analysis. The second chapter studies and summarizes the basic theories of demolition system and duty crime, and defines the relevant theories and concepts according to the legislative evolution of the whole demolition system and relevant cases and literature. And summarized the characteristics, types, behavior patterns, multiple links and harmfulness of duty crimes in urban demolition. Chapter three is to analyze the causes of duty crimes in urban demolition. The rapid development of the urbanization process, the unreasonable setting of the demolition organization and the non-standard of the demolition procedure; the dark box operation, the opaque work mechanism of demolition and the imperfect supervision system even connive at the occurrence of the duty crime in the urban demolition; at the same time, The lag in legal construction also provides an opportunity for the spread of job-related crimes in the field of urban demolition and relocation. In subjective reasons, because of the weak concept of the legal system of demolition personnel, low quality, collusion between officials and businessmen, and the prevalence of "latent rules" in the field of demolition and relocation, In addition, the influence of bad factors, such as traditional relationship society, human society and so on, has created the breeding soil for the duty crime in the urban demolition and relocation. Chapter 4th is the legal countermeasures and suggestions to prevent the duty crime in the field of urban demolition and relocation. In the judicial aspect, the author puts forward some countermeasures and suggestions to find out a way that can reduce the probability of duty crime in the current urban demolition and relocation.
