【摘要】：在这个各种浮躁现象和压力充斥的时代,人们往往多了一些情绪的宣泄,有些人面对外界刺激可以很好的转危为安,有些人却容易丧失理智,自我控制能力严重下降,甚至引发犯罪。在杀人罪中有一种激情型犯罪,激情杀人犯罪作为一种情绪型犯罪,是行为人在遭受强烈外界刺激时,基于愤怒、瞬间丧失自我控制能力而产生的一种犯罪行为。激情杀人犯罪行为具有不同于一般故意杀人行为的主观心理特征,外界诱因刺激和情绪特征是导致激情杀人犯罪的重要因素。当行为人情绪平复之后,常常表现为对犯罪行为的后悔状态。激情杀人犯罪作为一种极为常见的犯罪形式,无论是在大陆法系还是英美法系都有相关规定,而我国刑法条文和司法解释中却没有关于激情杀人犯罪的相关规定,这无疑增加了司法实践的多样化,对于指导实践,维护法律的公平正义是极为不利的。本文结合激情杀人犯罪的经典案例,以激情杀人犯罪的主观心理特征为主线展开分析,共分为四部分。首先明确杀人罪的概念和构成要件,并对杀人罪进行分类,将激情型杀人与预谋型杀人相区别,将激情杀人作为杀人罪的一个类型进行分析。其次,对激情杀人犯罪的主观心理特征进行分析。激情杀人犯罪的动机起因是内外因共同作用的结果。人的需要是激情杀人犯罪动机形成的动力,自我控制能力失调是引发激情杀人犯罪的内在驱动力,危险心结是激情杀人犯罪的创伤性刺激源,外部诱因刺激是导致激情杀人犯罪的决定性因素。经研究发现一般理性人在激情诱因驱使下可以产生激情杀人犯罪,被害人的不当言行是导致激情杀人犯罪的一个重要原因,激情杀人的情绪特征通常表现为愤怒。再次,本文从激情杀人犯罪的客观方面分析激情杀人的行为和结果,并通过案例分析的方式,明确了激情冲动行为和应激反应行为的不同。最后,本文通过对激情杀人犯罪的主观和客观方面的特征分析,提出了激情杀人犯罪在立法和司法方面的缺陷和完善建议,尝试借鉴他国在激情杀人犯罪方面的立法,在我国刑事立法领域提出关于激情杀人犯罪的立法建议,并完善激情杀人罪在我国司法领域的缺陷,在量刑时充分考量当事人双方的关系,考量受害人有无过错,对犯罪嫌疑人在量刑上给予更多的人道主义关照。希望通过本文的写作,弥补激情杀人犯罪在司法实践中的多样化现象,遵循刑法的谦抑精神和宽容性,贯彻落实我国“宽严相济”的刑事政策,达到预防激情杀人犯罪的目的,以维护法律的公平和正义。
[Abstract]:In this age of impetuous phenomena and pressures, people tend to get more emotional relief. Some people can turn the corner in the face of external stimuli, while others are prone to losing their minds and their ability to control themselves seriously. There is a crime of passion in homicide. As an emotional crime, the crime of passion homicide is based on anger when the perpetrator is strongly stimulated by the outside world. An act of crime resulting from the instant loss of self-control. The crime of passion homicide has the subjective psychological characteristics different from the common intentional killing. The stimuli and emotional characteristics of the outside world are the important factors leading to the crime of passion homicide. When the behavior of the actor is calm down, it is often expressed as a state of regret for the crime. As a very common form of crime, the crime of passion homicide is a very common form of crime. Whether in the civil law system or the common law system, there are relevant provisions, but there are no relevant provisions on the crime of passion homicide in the articles of criminal law and judicial interpretation of our country, which undoubtedly increases the diversification of judicial practice and guides the practice. It is extremely disadvantageous to safeguard the fairness and justice of the law. Based on the classic case of passion homicide, this paper analyzes the subjective and psychological characteristics of the crime of passion homicide, and it is divided into four parts. Firstly, the concept and constituent elements of the crime of homicide are defined, and the crime of homicide is classified. This paper distinguishes passion homicide from premeditated homicide, and analyzes passion homicide as a type of homicide. Secondly, This paper analyzes the subjective psychological characteristics of the crime of passion homicide. The motive of the crime of passion homicide is the result of the joint action of the internal and external factors, and the need of the human being is the motive force of the motive of the crime of the crime of passion homicide. The disorder of self-control is the internal driving force that causes the crime of passion murder, and the dangerous knot is the traumatic source of stimulus for the crime of passion killing. The external inducement stimulation is the decisive factor that leads to the crime of passion killing. The research shows that the common rational person can produce the crime of passion murder under the impassioned inducement, and the improper words and deeds of the victim are one of the important reasons leading to the crime of passion killing. The emotional characteristics of passion killing are usually expressed in anger. Thirdly, this paper analyzes the behavior and result of passion killing from the objective aspect of the crime of passion killing, and through the way of case study, Finally, through the analysis of the subjective and objective aspects of the crime of passion homicide, this paper puts forward the defects and suggestions of the legislation and judicial aspects of the crime of passion homicide. This paper tries to draw lessons from the legislation of other countries in the crime of passion homicide, puts forward some legislative suggestions on the crime of passion homicide in the field of criminal legislation of our country, and consummates the defects of the crime of passion homicide in the judicial field of our country. In sentencing, we should give full consideration to the relationship between the two parties, consider whether the victim is at fault, and give more humanitarian attention to the criminal suspect in sentencing. I hope that through the writing of this article, To make up for the diversification of the crime of passion homicide in judicial practice, to follow the modest spirit and tolerance of criminal law, to carry out the criminal policy of "combining leniency and severity with justice", and to achieve the purpose of preventing crime of passion homicide.
