生产、销售有毒、有害食品罪相关问题研究

【摘要】:食品是人们生存与发展的必需物质,安全的食品更是其基础与保障。目前,社会大众也已普遍重视食品安全问题。生产、销售有毒、有害食品罪是危害食品安全犯罪中最严重的一种犯罪,本罪在打击食品领域的犯罪行为,保障公众生命健康合法权益,维护市场经济秩序等方面起着重要的作用。对本罪的研究分析,有着重要的现实意义。除了引言外,本文的主要内容分为五个部分:笔者在本文的第一部分中,综合了理论界对本罪的既遂形态的各种观点,通过深入探析,得出本罪属于典型的抽象危险犯的结论。在本文的第二部分中,笔者重新定位本罪的行为类型,将本罪的行为分为“生产”和“销售”。笔者认为,“掺入行为”只是生产行为中最重要的一个组成部分,但不是能单独归为一种行为类型。在第三部分中,笔者对本罪行为对象的相关问题进行了探究。笔者认为本罪中“食品”的范围不应包括“食品添加剂”在内;“非食品原料”则是指加入食品中的除了生产加工食品的原料性物质之外的其他物质。同时笔者也对“有毒”“有害”相关问题进行了认真地分析研究;在实践中,对于“有毒”、“有害”的认定需要依据客观鉴定。对有毒、有害的非食品原料的认定应由省级以上卫生行政部门指定的鉴定机构做出。在第四部分中,笔者主要研究了行为人主观“明知”的基本内容。行为人主观上的明知与否,是区别罪与非罪的重要因素。第五部分指出本罪在刑事立法方面的不足之处,如刑罚体系设置的不合理等问题,并提出要完善刑事责任体系,增设资格刑的建议。总之,食品安全的重要性是有目共睹的,因此对本罪的研究有着重要的意义。这不仅能够减少食品犯罪的数量,保障人民群众的生体健康与生命安全,更有益于我国的法制建设,从而实现我国构建和谐社会这一伟大目标。
[Abstract]:Food is the essential material for people's survival and development, and safe food is its foundation and guarantee. At present, the general public has also attached great importance to the problem of food safety. The crime of harmful food is one of the most serious crimes against food safety. The crime is aimed at cracking down on criminal acts in the field of food and safeguarding the legitimate rights and interests of public life and health. The research and analysis of this crime has important practical significance. Besides the introduction, the main content of this paper is divided into five parts: the author in the first part of this article, This paper synthesizes all kinds of viewpoints of the accomplished form of this crime in the theoretical circle, through the thorough analysis, draws the conclusion that this crime belongs to the typical abstract dangerous crime. In the second part of this article, the author redefines the behavior type of this crime. The behavior of this crime is divided into "production" and "sale". The author thinks that "adulteration" is only one of the most important components of the production behavior, but it can not be classified as a single type of behavior. In the third part, The author probes into the related problems of the object of this crime. The author thinks that the scope of "food" in this crime should not include "food additive", and "non-food raw material" refers to the addition of food in addition to the production and processing of food. At the same time, the author has carried on the careful analysis and research to the "toxic" "harmful" related problems; In practice, the identification of "toxic" and "harmful" should be based on objective identification. The identification of toxic and harmful non-food raw materials should be made by an appraisal agency designated by the administrative department of health at or above the provincial level. In part 4th, The author mainly studies the basic content of the subjective "knowing" of the perpetrator. The subjective knowledge or not is the important factor to distinguish the crime from the non-crime. Part 5th points out the deficiency of the crime in the criminal legislation. Such as the unreasonable setting of the penalty system, and put forward the suggestion of perfecting the criminal responsibility system and increasing the qualification penalty. In short, the importance of food safety is obvious to all. Therefore, the study of this crime is of great significance. It can not only reduce the number of food crimes, protect the health and safety of the people, but also benefit the legal construction of our country. In order to achieve the great goal of building a harmonious society in China.
