检察视野下的高校职务犯罪预防

【摘要】：目前,我国出现了对高校领域相关管理和监督制约的滞后。在检察实务工作中,检察机关尚未在高校监管这一领域发挥自身的监督职能,更未能与高校共同打造出“检校协作”的职务犯罪预防体系来预防和约束管理者的行为。可以预计,通过此种体系的实现,更好的理顺大学的管理结构和模式,最终在全国高校实现现代大学制度。目前我国一些高校已经开始探索性的开展与检察机关合作来构筑适合自身的高校预防职务犯罪体系,以期通过引入司法监督到校园管理体制中来的方式,实现对可能出现职务犯罪的领域的预防控制与惩治。本文中,通过参考现代大学的优秀管理经验和制度设立,结合实践中总结出来的检察监督工作在高校中的开展和应用。只有不断加强对高校管理权力的控制和相应制衡,才能进一步建立全方位无死角的监督系统。只有大力创新各项管理制度,才能实现管理者和相关责任人员的“不想腐败、不敢腐败、不能腐败”。这是为高校校园打造廉洁制度环境,是为权力行使套上监督“笼头”,更是为实现现代大学制度打下良好的基础。
[Abstract]:At present, there has been a lag in the management and supervision of colleges and universities. In the practice of procuratorial work, the procuratorial organs have not yet played their own supervisory functions in the field of university supervision. It can be expected that through the implementation of this system, the management structure and mode of the university can be better straightened out by the failure to create a duty crime prevention system with the cooperation of colleges and universities to prevent and constrain the behavior of managers. Finally, the modern university system is realized in national universities. At present, some colleges and universities in our country have started to cooperate with procuratorial organs to build a system of preventing job-related crimes suitable for their own institutions of higher learning. In order to achieve the prevention, control and punishment of the possible field of job-related crime by introducing judicial supervision into the campus management system. In this paper, by referring to the excellent management experience and system establishment of modern universities, Combining the work of procuratorial supervision summarized in practice in the development and application of colleges and universities. Only by constantly strengthening the control and corresponding checks and balances on the management power of colleges and universities, Only by vigorously innovating various management systems can we realize that managers and related responsible personnel "do not want to corrupt and dare not corrupt," This is to create a clean institutional environment for the university campus, to supervise the exercise of power, and to lay a good foundation for the realization of the modern university system.
