交通肇事犯罪若干问题的思考

【摘要】：近年来随着经济水平的不断提高,交通运输业也迅速发展,全国各地交通肇事案件呈逐年上升的趋势,引起了社会的广泛关注。本文以交通肇事罪为基本研究对象,在刑法基本原理与交通肇事案件中遇到的实际问题基础上,对一些司法实践中的处理难题进行了分析和探讨,并力求在现有研究成果的基础上提出一些合理性的立法建议,以丰富我国交通肇事类犯罪处理体系。本文共分为四部分。第一部分是交通肇事罪的概念及立法沿革。主要介绍了交通肇事罪的概念及1979刑法后我国交通肇事罪在立法、司法解释上的变化。笔者认为交通肇事罪应结合刑法典133条定义为,行为人实施了违反我国交通运输管理法规的行为,造成被害人重伤、死亡或者公私财产因交通事故遭受重大损失的法定危害结果才构成交通肇事罪。第二部分主要论述了交通肇事罪在刑事立法及司法解释上的缺陷,提出“法定刑偏轻”“以交通肇事罪共犯论处”、“赔偿能力高低影响定罪”“刑罚种类单一”“逃逸行为是量刑情节还是定罪情节规定有争议”五方面的不足。第三部分剖析了域外交通肇事罪立法概述并分析了域外交通肇事罪的立法特点对照我国立法现状,认为域外立法起步早相对完备,对我国现行刑法中关于交通肇事犯罪立法有一定的借鉴意义。第四部分结合我国交通肇事罪的立法不足,参照国外立法经验,通过前部分的深入分析并结合我国国情,提出提高量刑幅度、细化罪名将交通肇事逃逸单独定罪、废除以赔偿能力为定罪标准的规定、扩大交通肇事罪的刑罚种类、完善刑事和解制度的建议。
[Abstract]:In recent years, with the continuous improvement of the economic level, the transportation industry has also developed rapidly. The traffic accident cases in various parts of the country are on the rise year by year, which has aroused the widespread concern of the society.Based on the basic principles of criminal law and the practical problems encountered in traffic accident cases, this paper analyzes and discusses some difficult problems in judicial practice.On the basis of the existing research results, the author tries to put forward some reasonable legislative suggestions in order to enrich the handling system of traffic accident crimes in China.This paper is divided into four parts.The first part is the concept and legislative evolution of traffic accident crime.This paper mainly introduces the concept of traffic accident crime and the change of legislation and judicial interpretation of traffic accident crime after 1979 criminal law.The author thinks that the crime of causing traffic accident should be defined by 133 article of the Criminal Code, which means that the perpetrator carried out the act of violating the regulations of traffic and transportation management of our country and caused serious injury to the victim.Death or public-private property as a result of serious losses due to traffic accidents legal consequences constitute traffic accident crime.The second part mainly discusses the defects of the traffic accident crime in the criminal legislation and judicial interpretation, and puts forward that "the legal penalty is too light" and "the traffic accident crime accomplice is to be punished".The deficiency of "compensation capacity" affects five aspects: conviction, "single penalty category", whether the circumstances of sentencing or the circumstances of conviction are controversial.The third part analyzes the legislative summary of the extraterritorial traffic accident crime and analyzes the legislative characteristics of the extraterritorial traffic accident crime compared with the current situation of legislation in our country, and thinks that the extraterritorial legislation starts relatively early and is relatively complete.It has certain reference significance to the legislation of traffic accident crime in the current criminal law of our country.The fourth part combines our country traffic accident crime legislation insufficiency, consults the foreign legislation experience, through the first part thorough analysis and the union our country national condition, proposed to raise the sentencing range, the fine charge will traffic accident escape alone conviction,The suggestion of perfecting the system of criminal reconciliation is to abolish the provision of compensation capacity as the standard of conviction, to enlarge the penalty category of traffic accident crime and to perfect the criminal reconciliation system.
