拒不支付劳动报酬罪探析

【摘要】:当前国家高度重视保障劳动报酬支付工作,在《刑法修正案(八)》增设了拒不支付劳动报酬罪之后,最高人民法院又发布了《关于审理拒不支付劳动报酬刑事案件适用法律若干问题的解释》,用于在司法实践中正确适用拒不支付劳动报酬罪。虽然解决拖欠劳动者劳动报酬的工作取得了积极进展,但是拖欠劳动报酬案件数量依然比较大,解决拖欠劳动报酬的问题仍是一件任重而道远的任务。就目前现状来看,在处理此类问题中由法院处理的拒不支付劳动报酬案件所占比重明显较低,拒不支付劳动报酬罪在司法实践中也有很多实务问题存在争议。 本文结合《刑法修正案(八)》和最高法发布的《解释》,从拒不支付劳动报酬罪的立法本意入手,对本罪的犯罪构成作简要陈述,,重点分析本罪在适用过程中出现的各类问题,为立法完善和司法实践提出一些建议。主要分为以下四个部分: 第一部分是对拒不支付劳动报酬罪的概述,第一节简要介绍本罪的立法背景,第二节简要介绍本罪在司法实践中遇到的一些困惑,主要包括学界对设立本罪名是否合适的学术争议和本罪在司法实践中的现状。 第二部分对本罪的构成特征进行法理分析并简要论述。在阐述本罪犯罪构成要件的同时,分析了一些比较有争议的学术观点。对本罪主观方面是否需要表现为“恶意”、双重客体、“经责令支付仍不支付”的内涵等学界争议提出了笔者的观点。 第三部分对拒不支付劳动报酬罪在司法适用中的实务问题展开讨论,第一节主要分析本罪在法律适用中遇到的问题,分别从事实劳动关系、普通民事合同关系和非法用工三个角度展开讨论;第二节分析在用人单位延迟、克扣支付劳动报酬的情形下本罪的入罪标准;第三节采用比较的方法对本罪与侵占罪、诈骗罪、拒不履行判决、裁定罪的区别分别进行阐述。 第四部分对拒不支付劳动报酬罪的刑罚裁量的内容展开分析和讨论,笔者对宽严相济的刑事政策下本罪刑罚裁量、法定量刑情节和酌定量刑情节的适用问题进行了分析,并对拒不支付劳动报酬罪适用公诉案件的当事人和解程序作出了一定构想。
[Abstract]:At present, the state attaches great importance to the work of safeguarding the payment of labor remuneration. After the addition of the crime of refusing to pay the remuneration for work in the Criminal Law Amendment (8), The Supreme people's Court has also issued an explanation on the application of the law in criminal cases of non-payment of labor remuneration, which is used to correctly apply the crime of refusing to pay labor remuneration in judicial practice. Although positive progress has been made in solving the problem of unpaid labor remuneration, the number of cases of unpaid remuneration is still relatively large, and solving the problem of unpaid remuneration is still a long task. As far as the present situation is concerned, the proportion of cases of non-payment of labor remuneration handled by the court is obviously low, and the crime of refusing to pay labor remuneration also has many practical problems in judicial practice. Combined with the Criminal Law Amendment (8) and the interpretation issued by the Supreme Law, this paper, starting with the legislative intent of the crime of refusing to pay the remuneration for labor, makes a brief statement on the constitution of the crime, and focuses on the analysis of various problems arising in the course of application of the crime. Some suggestions are put forward for legislative perfection and judicial practice. It is divided into the following four parts: The first part is an overview of the crime of refusing to pay the remuneration for labor. The first section briefly introduces the legislative background of the crime, the second section briefly introduces some puzzles encountered in the judicial practice. It mainly includes academic controversy about the appropriateness of establishing this crime and the present situation of this crime in judicial practice. The second part analyzes the constitution of this crime and discusses it briefly. At the same time, it analyzes some controversial academic viewpoints. The author puts forward the author's viewpoint on whether the subjective aspect of this crime should be manifested as "malice", "double object", "ordered payment still not to pay" and so on. The third part discusses the practical problems in the judicial application of the crime of refusing to pay labor remuneration. The first section mainly analyzes the problems encountered in the application of the law, respectively from the facts of labor relations. General civil contract relationship and illegal employment are discussed from three angles: the second section analyzes the standard of incrimination of this crime under the circumstances of employer delay and withholding of payment of labor remuneration; the third section uses comparative methods to analyze the crime, embezzlement, fraud, etc. If you refuse to fulfill the judgment, the distinction between the judgment and the judgment shall be explained separately. The fourth part analyzes and discusses the content of penalty discretion of the crime of refusing to pay labor remuneration. The author analyzes the application of penalty discretion, statutory circumstances of sentencing and discretionary circumstances of sentencing under the criminal policy of combining leniency and severity. The conciliatory procedure of the parties in the public prosecution case is also proposed.
