论我国出生人口性别比失衡的刑法应对

【摘要】：我国出生人口性别比持续高位且已经严重扭曲,男女比例严重失衡,人口安全和社会稳定面临严峻考验。出生人口性别比失衡会挑战传统家庭伦理、加剧社会管理风险、恶化人与自然的关系并增大犯罪率。现有行政性惩处调查取证难度大、处罚标准高,利益剥夺与资格取缔作用有限。"标本兼治、治标为主"治理模式的确定,迫切要求对出生人口性别比失衡进行刑法应对。对出生人口性别比失衡进行刑法应对,在入罪模式上应取"立新"而弃"破旧",在入罪技术上应取"性别鉴定行为的犯罪化"而弃"导致终止妊娠之性别鉴定行为的犯罪化"。
[Abstract]:The sex ratio of birth population in our country is high and has been seriously distorted, the ratio of male and female is out of balance, and the security of population and social stability are facing a severe test. The imbalance of sex ratio of birth population will challenge the traditional family ethics, aggravate the risk of social management, worsen the relationship between man and nature and increase the crime rate. The existing administrative punishment investigation is difficult to obtain evidence, the penalty standard is high, and the function of disenfranchisement and disqualification is limited. " It is urgent to deal with the imbalance of sex ratio of birth population by criminal law in order to determine the governance mode of treating both symptoms and symptoms. In order to deal with the imbalance of sex ratio of birth population in criminal law, we should adopt "new legislation" and abandon "shabby" in the mode of incrimination, and decriminalize the act of sex identification which leads to the termination of pregnancy.
