论创立经济刑法的哲学基础和学科价值

【摘要】：在我国,由于经济刑法规范缺失,形成刑法系统和经济法治体系两豁口,致使治罪效果不大理想,直接影响经济发展和社会建设。需要在法治之下作进一步的科学探求和实证,以纠偏去错、去伪存真,支持经济刑法创立。做好经济刑法理论研究,着重挖掘经济犯罪不同于一般刑事犯罪的特性,探求建立在这种特性基础上的经济刑法规范,从而建立经济刑法科学:即以经济刑法为研究对象,阐明危害市场经济行为的犯罪与其经济刑事责任和经济刑罚之间的关系及其规律,并总结立法司法有益经验,又顾及有关诉讼、治罪对策和各国经济刑法比较等而有所创新和发展的科学。经济刑法是涉及多学科领域的跨学科研究,其结果会形成一部系统、贴实、针对性很强的专门规范经济犯罪的单行刑事法律。该法律性质是一种新形式的特别刑法。

It is necessary to make further scientific exploration and demonstration under the rule of law in order to correct errors, identify false things, retain the real things, and support the establishment of economic criminal law. Do a good job of the economic criminal law theory research, emphatically excavate the characteristic that the economic crime is different from the ordinary criminal crime, seek the economic criminal law norm based on this kind of characteristic, thus establish the economic criminal law science: namely take the economic criminal law as the research object, Clarifying the relationship between crimes against the market economy and their economic criminal responsibility and economic penalties, and summarizing the beneficial experience of legislative and judicial practice, taking into account the relevant proceedings, The science of innovation and development of crime countermeasures and comparison of economic and criminal law of various countries and so on. Economic criminal law is an interdisciplinary study involving multi-disciplinary fields, and its result will form a systematic, solid and highly targeted criminal law that specifically regulates economic crimes. This legal nature is a new form of special criminal law.
