【摘要】：面对刑事司法领域中的难办案件,司法者面临各种解释论上的难题。解释者应该秉持基本正义观的立场,以结论的妥适性为目标,综合运用刑法中的各种解释方法。具体到赵春华案件中,可以从非法持有枪支罪客观要件上的"非法性"和"枪支"的实质性角度分析,结合刑法理论上的禁止错误理论,运用"当然解释"的方法,实现对该行为非罪化或者非重刑化处理的目标。
[Abstract]:In the face of the difficult cases in the field of criminal justice, the judiciary faces various interpretative problems. The interpreter should hold the position of the basic concept of justice, aim at the appropriateness of the conclusion, and use all kinds of interpretation methods in the criminal law. In the case of Zhao Chunhua, the "illegality" and the "unlawful nature" of the objective elements of the crime of guns can be held from the non law. By analyzing the substantive angle of the firearms, combining the theory of the criminal law for the prohibition of error, and using the method of "explaining it of course", the goal of the non crime or non heavy punishment of the act is achieved.
