“微反应”分析在职务犯罪侦查中的应用

【摘要】：正"微反应"是一种在受到刺激时所产生的第一本能反应,"微反应"分析作为心理测试方式可以为审讯提供依据,也可以为查找证据提供线索,其科学性及实用价值不断得到认可。虽然该理论在司法实践应用中还存在法律层面上的问题和技术难点,但无论是实现"科技强检"还是提高职务犯罪案件侦查效能,"微反应"分析都具有广阔的应用前景,况且修改后刑诉法明确赋予检察机关职务犯罪技术侦查权,这为该理论引入司法程序预留了空间。
[Abstract]:Positive "microreactions" are the first instinctive reactions that occur when stimulated, and "microreaction" analysis can be used as a psychological test to provide a basis for interrogations, as well as clues for finding evidence. Its scientific and practical value has been continuously recognized. Although there are still legal problems and technical difficulties in the application of this theory in judicial practice, the analysis of "micro-reaction" has a broad application prospect, whether it is to realize "scientific and technological enforcement" or to improve the efficiency of investigation of job-related crime cases. Moreover, the revised Criminal procedure Law explicitly grants the procuratorial organ the technical investigation power of duty crime, which reserves the space for introducing the judicial procedure into the theory.
