【摘要】：近年来,随着我国城市化进程的深入,特别是沿海经济带的大规模建设,非法采砂现象愈演愈烈,其中“三无”船舶非法采砂运砂情况尤为严重。“三无”船舶的存在严重危害了船舶管理秩序,其非法采砂运砂的行为危害极大,轻者造成造成了矿产资源的破坏,重者使公民生命财产安全受到了严重威胁,所以,我们有必要动用刑罚对其进行严厉的惩戒,以预防和减少类似事件的发生。目前的实践中,对于“三无”船舶非法采砂运砂行为的惩戒多为承担民事和行政责任,但对于那些造成严重后果,例如人员伤亡、失踪等情况,这就已经构成刑事犯罪应当承担刑事责任。在《刑法》分则的规定中,“三无”船舶非法采砂运砂行为造成严重后果的情况是符合一些罪名的犯罪构成要件的,例如：非法采矿罪、重大责任事故罪、重大安全责任事故罪、不报谎报安全事故罪、交通肇事罪,这些都可以用来规制“三无”船舶非法采砂运砂涉嫌犯罪的行为。本文从刑事法律规制的角度对“三无”船舶非法采砂运砂行为进行了分析：首先说明了“三无”船舶的概念及法律性质；其次重点分析了我国现在对于“三无”船舶非法采砂运砂行为的责任追究现状,即重民事、行政责任而轻刑事责任,案件难以进入刑事司法程序；再次进行了罪名分析,包括“三无”船舶非法采砂运砂行为可能涉嫌的刑事罪名和当前法院生效判例中的刑事罪名；最后提出了刑事司法对策建议,这是对于当前我国责任追究现状提出的,包括案件移送环节和犯罪的认定问题。
[Abstract]:In recent years, with the development of urbanization, especially the large-scale construction of coastal economic belt, the phenomenon of illegal sand mining is becoming more and more serious. The existence of the "three nots" ship seriously endangers the ship management order, its illegal sand mining and sand transportation behavior is extremely harmful, the light person has caused the destruction of mineral resources, the heavy one has made the citizen's life and property safety seriously threatened, so, It is necessary to punish them severely to prevent and reduce the occurrence of similar incidents. In current practice, the punishment for illegal sand mining and sand transportation by the "three noes" ships is mostly civil and administrative liability, but for those cases that cause serious consequences, such as casualties, missing persons, and so on, This already constitutes a criminal offence should bear criminal responsibility. In the provisions of the sub-rule of the Criminal Law, the situation of serious consequences caused by the illegal sand mining and sand transportation by "three noes" ships is in line with the constitutive elements of a number of crimes, such as the crime of illegal mining, the crime of serious accident of responsibility, The crime of major safety accident, the crime of not reporting safety accident falsely, the crime of causing traffic accident, all of these can be used to regulate the suspected crime of "three noes" ship illegally mining sand and transporting sand. From the angle of criminal legal regulation, this paper analyzes the illegal sand mining and sand transport behavior of "three noes" ships: firstly, it explains the concept and legal nature of "three nots" ships; Secondly, it focuses on analyzing the current situation of the investigation of the responsibility for the illegal sand mining and sand transportation of the "three noes" ships in our country, that is, emphasizing civil, administrative responsibility rather than criminal responsibility, so the case is difficult to enter into the criminal judicial procedure; again, the charge analysis is carried out. Including the criminal charges which may be suspected of illegal sand mining and sand transportation by the "three noes" ships and the criminal charges in the current court's effective jurisprudence; finally, the criminal judicial countermeasures and suggestions are put forward, which are put forward for the current situation of our country's responsibility investigation.
