论强奸罪中的“违背妇女意志”的认定标准

【摘要】：在我国刑法中，强奸罪是指违背妇女意志，采用暴力、胁迫或者其他手段，强行与女性发生性交的行为。强奸罪的定义明显将“违背妇女意志”作为了客观方面构成要件的重要组成部分。而“违背妇女意志”这一要素带有明显的主观色彩，在司法实践中一直是判断和认定的难点所在。本文以“违背妇女意志”为切入点对强奸罪进行研究，以期对司法实践工作有所裨益。本文共分为5个部分：第一部分：通过对强奸罪客观方面构成要件的分析，揭示“违背妇女意志”这一要素是客观方面的核心内容，并在借鉴英美法系等国家多种学说的基础上，进一步研究分析认定“违背妇女意志”是强奸罪的本质特征。第二部分：通过对强奸罪侵犯法益的分析，，提出强奸罪侵犯的法益是女性对性交行为的不同意权，从而进一步重点论述了“违背妇女意志”的含义为未经被害人同意。第三部分：通过分析被害人同意的判断因素、借鉴吸收国外有关被害人同意的认定模式等理论，试图对“违背妇女意志”这一要素予以客观化定型，并重点分析了被害人认识错误的“同意”的效力问题以及行为人对未经被害人同意的认识可能性分析，以便具体指导司法实践。第四部分，在分析认定强奸罪中强制手段是“违背妇女意志”外在形式，“违背妇女意志”是强制手段的内容的基础上，对强制手段的表现形式、实质标准等予以研究，逐步深入分析“违背妇女意志”的客观表现。第五部分，分别对“违背妇女意志”的几种特殊表现情况：利用被害人孤立无援状态进行性交、行为人以为被害人不同意而实际上被害人同意性交、被害人具有精神缺陷等特殊情况进行性交、第一次强奸后保持通奸关系等进行逐一进行探究。
[Abstract]:In the criminal law of our country, the crime of rape refers to the act of forcible sexual intercourse with a woman against the will of a woman and by violence, coercion or other means. The definition of rape obviously regards "against the will of women" as an important component of objective elements. The element of "against the will of women" has obvious subjective color and has always been the difficulty of judgment and determination in judicial practice. This paper studies the crime of rape from the point of view of "against the will of women" in order to benefit the judicial practice. This paper is divided into five parts: The first part: through the analysis of the constitutive elements of the objective aspect of the crime of rape, it is revealed that "against the will of women" is the core content of the objective aspect, and on the basis of drawing lessons from various theories in countries such as Anglo-American legal system, etc. Further research and analysis concluded that "against the will of women" is the essential characteristic of rape. The second part: through the analysis of the crime of rape, the author puts forward that the legal interest of the crime of rape is the right of women's disapproval of sexual intercourse, and further discusses the meaning of "against the will of women" as without the consent of the victim. The third part: through the analysis of the judgment factors of victim consent, draw lessons from foreign theories about victim consent, and try to objectively set the element of "against the will of women". It also analyzes the effectiveness of the victim's "consent" and the possibility of the victim's understanding without the victim's consent in order to guide the judicial practice. The fourth part, on the basis of the analysis that the compulsory means in the crime of rape is the external form of "against the will of women" and "against the will of women" is the content of the coercive means, the paper studies the manifestation and substantive standard of the coercive means. Analyze the objective performance of "against the will of women" step by step. In the fifth part, several special manifestations of "against the will of women" are given: sexual intercourse is conducted by using the victim's isolation and helplessness, and the perpetrator thinks that the victim does not agree but the victim actually consents to sexual intercourse. The victim has mental defects and other special circumstances to conduct sexual intercourse, the first rape to maintain adultery relationship one by one to explore.
